MINUTES FROM THE HUNTSVILLE CITY COUNCIL REGULAR MEETING HELD ON THE 16 DAY OF OCTOBER 2018, IN
THE CITY HALL, LOCATED AT 1212 AVENUE M, IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS, AT 6:00 P.M.
The Council met in a regular session with the following:

COUNCILMEMBERS ABSENT: Paul Davidhizar

CALL TO ORDER – Mayor Brauninger called the meeting to order at 6:00 p.m.

Mayor Brauninger gave the invocation and Sean Ordaz of HISD led the pledges.
1. CONSENT AGENDA
Public Comments will be called for by the presiding officer before action is taken on these items. (Approval of Consent
Agenda authorizes the City Manager to implement each item in accordance with staff recommendations. An item may
be removed from the Consent Agenda and added to the Statutory Agenda for full discussion by request of a member
of Council.)
a. Approve the minutes of the City Council meeting held on October 2, 2018. \[Lee Woodward, City Secretary\]
b. Adopt Resolution 2019-01 designating the official newspaper for the City of Huntsville for Fiscal Year 2018-2019.

c. Adopt Ordinance 2019-03, amending the traffic schedule to ratify No Parking signs on Boettcher Drive between

d. Authorize the renewal of the Microsoft enterprise software agreement. \[Bill Wavra, IT Director\]
e. Authorize the City Manager to approve the first amendment to the Solid Waste Transfer Station agreement with
Stella Environmental Services, LLC. \[Brent S. Sherrod, P.E., Public Works Director\]
f. Authorize the City Manager to enter into a contract with Nuphysicia Health of Texas for an on-site employee health
clinic. \[Julie O’Connell, Human Resources Director\]
g. Authorize the City Manager to grant an easement for electric power facilities to Entergy Texas, Inc. through the A.

h. Authorize the Public Works Director to approve the renewal of Industrial User Discharge Permit 0100 for Gardner

Mayor Pro Tem Olson moved to approve the consent agenda; the motion was seconded by Councilmember McCaffety. The
motion was adopted, 8-0.
2. CITY COUNCIL/CITY MANAGER/CITY ATTORNEY
a. FIRST READING - Presentation, discussion, public comment, and possible action to consider adopting Ordinance
2019-02 amending the Huntsville Code of Ordinances, specifically Chapter 12, Buildings and Building Regulations,
first reading. \[Kevin Byal, Director of Development Services/Building Official\]
First reading, no action taken. Councilmember Allen signed an affidavit of Conflict of Interest and did not participate in the
discussion.
b. FIRST READING - Presentation, public comment, discussion, and possible action to consider authorizing the City
Manager to award the construction contract for Old Colony Road/Trinity Cutoff Waterline Replacement Project No.
18-10-03, first reading. \[Y. S. “Ram” Ramachandra, City Engineer\]
Councilmember Rodriquez moved to waive the second reading per the provisions of the adopted Council Rules of Procedure
and authorize the City Manager to award the construction contract to 5-T Utilities, Inc. for the construction of Old Colony
Road/Trinity Cutoff Waterline Replacement Project No. 18-10-03; the motion was seconded by Mayor Pro Tem Olson. The
motion was adopted, 7-1, Councilmember Emmett voting against.
c. FIRST READING - Presentation, public comment, discussion, and possible action to consider authorizing the City
Manager to apply for an Assistance to Firefighters Grant designating the City Manager as the City’s Authorized
Representative and adopting Resolution 2019-02 in support of same. \[Dr. Sherry McKibben, Director of
Neighborhood Resources; Chief Kevin Lunsford, Director of Public Safety\]
Councilmember Loll moved to authorize the City Manager to apply for an Assistance to Firefighters Grant (AFG) for
$371,235.00 plus $41,248.00 in matching funds, designate the City Manager as the City’s Authorized Representative and
adopt Resolution 2019-02 in support of same; the motion was seconded by Councilmember Allen. The motion was adopted,
8-0.
d. Presentation, public comment, discussion, and possible action to consider authorizing the City Manager to apply
for a Texas Department of Agriculture Main Street grant, designating the City Manager as the City’s Authorized
Representative, and adopting Resolution 2019-04 in support of same. \[Dr. Sherry McKibben, Director of
Neighborhood Resources; Debra Charbonneau, Main Street Coordinator\]
Councilmember Rodriquez moved to authorize the City Manager to apply for a Texas Department of Agriculture Main Street
grant for $250,000.00, plus $110,000.00 in matching funds, designate the City Manager as the City’s Authorized
Representative, and adopt Resolution 2019-04 in support of same; the motion was seconded by Mayor Pro Tem Olson.
Cheryl Spencer and Bert Lile gave public comment.
The motion was adopted, 7-1, Councilmember Allen voting against.
e. Presentation, public comment, discussion, and possible action to consider authorizing the City Manager to apply
for an Economic Development Administration Grant designating the City Manager as the City’s Authorized
Representative and adopt Resolution 2019-03. \[Aron Kulhavy, City Manager; Dr. Sherry McKibben, Director of
Neighborhood Resources\]
Councilmember McCaffety moved to authorize the City Manager to apply for an Economic Development Administration
Grant for up to $1.425 million including a $285,000.00 match from the City, designate the City Manager as the City’s
Authorized Representative, and adopt Resolution 2019-03, in support of same; the motion was seconded by Councilmember
Humphrey, The motion was adopted, 8-0.
3. CITY COUNCIL/CITY MANAGER/CITY ATTORNEY
a. Presentation, public comment, discussion, and possible action to consider a request by Councilmember Ronald
Allen for an update on the water diversion on private property at Elkins Lake discussion.
City Director of Development Services Kevin Byal provided an update on examination of other cities’ requirements and
additional review of submitted plans.
4. REQUESTS FOR CITIZEN PARTICIPATION
An opportunity for citizens to be heard on any topic and for the City Council to participate in the discussion. No action will be
taken.
No requests were received by noon on Tuesday, October 9, 2018.
5. MEDIA INQUIRIES RELATED TO MATTERS ON THE AGENDA
No media inquiries were made.
6. ITEMS OF COMMUNITY INTEREST
(Hear announcements concerning items of community interest from the Mayor, Councilmembers, and City staff, for
which no action will be discussed or taken.)
Mayor Brauninger reminded citizens that early voting begins October 22. He asked voters to take time to perform this important
duty and visit the City elections page at HuntsvilleTX.gov/Elections to find all information.
Councilmember Humphrey spoke about accentuating the positive and invited residents to email her with topics about
revitalization, rebuilding, reorganizing and renewing Huntsville. She reminded all not to put recycling inside plastic bags, to rinse
out containers before recycling, and to visit HuntsvilleTX.gov/Recycling.
Councilmember Rodriguez invited citizens to attend the 2018 State of the City being held from 5:30 to 7 p.m. Tuesday, October
30, at the Walker County Storm Shelter.
Councilmember McCaffety encouraged the community to support the combined HISD/SHSU Homecoming parade set for
October 25.

Councilmember Loll announced that Sam Houston Statue’s 24 birthday will be celebrated on Monday, October 22, with punch
and cake all day and a 10 percent discount at the gift shop.
Councilmember Allen announce the cancellation of the Haunted Trails event and invited residents to enjoy Scare on the Square
from 2 to 5:30 p.m., Saturday, October 27.
