RESO 1980-18 - NHSP BidRESOLUTION NO. 80 -18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DETERMINING A PROTEST OF AWARD OF THE CONTRACT FOR THE PARKER CREEK SEWER TREATMENT FACILITY BY ANGLETON GENERAL MECHANICAL, INC.; AFFIRMING AWARD TO BRYAN CONSTRUCTION COMPANY; AND MAKING VARIOUS FINDINGS AND PROVISIONS RELATED THERETO. WHEREAS, on May 20, 1980, City Council awarded the contract for construction of the PARKER CREEK SEWAGE TREATMENT FACILITY TO BRYAN CONSTRUCTION COMPANY OF BRYAN, TEXAS; and WHEREAS, Angleton General Mechanical, .a protest document dated May 22, failed to award said contract to and requested a determination of Inc. filed with this Council 1980, alleging that Council the lowest responsible bidder the protest by Council; and WHEREAS, a Committee of five Councilmembers was appointed to hear the protest and recommend action to the Council; and WHEREAS, City Council finds that the past record of performance of Angleton in the Huntsville area is not that quality of work expected of a responsible contractor because Angleton failed to timely pay bills to local vendors; and Angleton failed to adequately respond to citizen complaints and problems generated by their work; and Angleton failed to keep appointments or provide personnel necessary to coordinate their work with local governmental concerns; and WHEREAS, City Council is concerned that Angleton lacks: (a) the specialized experience and technical competence to construct the Parker Creek facility; and (b) the familiarity with the types of problems appli- cable to construction of a large sewage treatment facility, and (c) the capacity to perform the work expeditiously considering the firm's current and planned work- loads and its financial status; and WHEREAS, the City's consulting engineer has submitted a recommenda- tion that the contract be awarded to Bryan Construction Company as the lowest responsible bidder; and WHEREAS, the Council Committee has recommended that the protest of Angleton be in all things overruled: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT Section 1: The Council hereby overrules the protest of Angleton and determines that at this time Angleton is not a responsible contractor to construct the Parker Creek Sewage Treatment facility. Section 2. Council further affirms and adopts its action taken on May 20, 1980, and awards Contract No. 1104, Parker Creek Sewage Treatment Plant to the lowest responsible bidder, Bryan Construction Company of Bryan, Texas, in the amount of $3,784,000.00, subject to any necessary approval by the Texas Department of Water Resources or the Environmental Protection Agency. Section 3. Council's written determination of this protest shall consist of this resolution, the Engineer's report dated May 12, 1980, and the record made before Council and its committee with regard to the protest of Angleton.
