RESO 1980-17 - Settles Majic SuitRESOLUTION NO. 80 -17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS AUTHORIZING SETTLEMENT OF LAWSUIT, AMERICAN GENERAL FIRE AND CASUALTY, OVER CONSTRUCTION OF SANITARY SEWER LINE FOR A SUM NOT TO EXCEED $5,000, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, American General Fire and Casualty Company has filed suit against the City of Huntsville to recover amounts expended on a performance bond on a sewer con- struction contract with the City; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS THAT: Section 7: The City Attorney and /or City Manager are hereby authorized to settle said lawsuit for a cash settlement not to exceed $5,000 upon receipt of a release or execution of judgment absolving the City from any and all liability with regard to the actions made the basis of said suit. Section 2: This resolution shall take effect immediately from and after its passage by City Council.
