RESO 1996-09 - TDHCA Home ProgramRESOLUTION 96 -09 RESOLUTION OF THE CITY OF HUNTSVILLE AUTHORIZING THE CITY TO ACT AS A COOPERATIVE ENTITY TO THE HUNTSVILLE HOUSING AUTHORITY'S SUBMISSION OF A HOME INVESTMENT PARTNERSHIP PROGRAM APPLICATION TO THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS FOR THE OWNER OCCUPIED HOUSING ASSISTANCE PROGRAM; AND, AUTHORIZING THE MAYOR TO ACT AS THE CITY EXECUTIVE OFFICER AND AUTHORIZED REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE CITY'S PARTICIPATION IN THE HOME PROGRAM. WHEREAS, the City desires to develop a viable community for all citizens; and, WHEREAS, certain conditions exist which represent a threat to the public health and safety and it is necessary and in the best interests of the City to act as a Cooperative Entity with the Huntsville Housing Authority for funding under the 1996 HOME Program. NOW, THEREFORE, BE IT RESOLVED: Section 1. THAT, the City is authorized to act as a Cooperative Entity for a HOME Program application to be filed by the on behalf of the Huntsville Housing Authority with the Texas Department of Housing and Community Affairs and be placed in competition for funding under the Owner Occupied Housing Assistance program; Section 2. THAT, the application be for $500,000 for housing assistance and $20,000 for administration to carry out the HOME Program; Section 3. THAT, a Memorandum of Agreement attached hereto as Exhibit "A" is hereby approved authorizing the City as a Cooperative Entity for this application; Section 4. THAT, the City Council directs and designates the Mayor as the City's Chief Executive Officer and Authorized Representative to act in all matters in connection with this application and the City's participation in the HOME Program; and, Section 5. THAT, it further be stated that the City will commit $62,500.00 as a local contribution towards the implementation of this project for infrastructure improvements. APPROVED: 4L- MAYOR ATTEST: CITY SECRETARY Exhibit "A" MEMORANDUM OF AGREEMENT THIS AGREEMENT, MADE THIS 7TH DAY OF MAY, 1996, HUNTSVILLE HOUSING AUTHORITY hereinafter referred to as APPLICANT, and the BETWEEN CITY OF HUNTSVILLE, hereinafter referred to as the COOPERATIVE ENTITY. WHEREAS, WHEREAS, WHEREAS, WHEREAS, the Applicant and Cooperative Entity have a common desire to develop a viable community for all citizens; certain housing conditions exist in the Applicant's jurisdiction which need to be addressed in the form of housing rehabilitation assistance; the Applicant and Cooperative Entity agree to jointly make application to the Texas HOME Partnership Program - Owner - Occupied Rehabilitation Program; and, it is necessary and in the best interests of the Applicant and Cooperative Entity to prepare this Memorandum of Agreement to define the roles of the Applicant and Cooperative Entity to implement an Owner - Occupied Rehabilitation Program. NOW, THEREFORE, BE IT RESOLVED: SECTION 1. The Applicant and the Cooperative Entity agree herein for the purposes of making a joint application to the Texas Department of Housing and Community Affairs under the HOME Partnership Program for grant funds for the Owner - Occupied Rehabilitation Program, hereinafter referred to as the Program. SECTION 2. The Applicant, shall be responsible for the overall administration and implementation of the Program. This includes the financial management, program design, establishing type of assistance, geographic location of assistance, financial design, marketing, issuing payments, procedures for determining the scope of work, procedures for selecting eligible homeowners, procedures for loan serving; contractor selection procedures; procedure for change orders, procedure for inspections, preparation of local Program guidelines, preparation of general construction specifications, compliance with contract special conditions; and, the compliance with all Program rules, guidelines and regulations. SECTION 3. The Cooperative Entity, shall work with the Applicant by assisting with the HOME Program out -reach efforts to inform potential program beneficiaries by acting as a resource for informational materials about the program on the rehabilitation of single - family homes. IN WITNESSETH HEREOF, the Applicant and the Cooperative Entity have executed this Agreement as of the date indicated above.
