RESO 1999-21A - MidSouth Water EstimateRESOLUTION NO. 99-21 A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AUTHORIZING THE PARTIAL ASSIGNMENT OF CERTAIN WATER PIPELINE EASEMENTS TO MID -SOUTH ELECTRIC COOPERATIVE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Huntsville has acquired water pipeline easements from certain property owners in order to construct a water line to the electric generating facility owned by Tenaska Frontier Partners, Ltd.; and WHEREAS, the City has installed mainline valves on the water pipeline on certain easements; and WHEREAS, it is necessary to obtain electrical service on those easements in order to operate the mainline valves; and WHEREAS, the electrical service will be provided by Mid -South Electric Cooperative and a partial assignment of the easement rights to Mid -South Electric Cooperative is necessary in order that it may provide the electrical service; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: A partial assignment of easement rights for the easements obtained from Melvin Morgan and wife, Shirley Morgan; Grace A. Cook and Edwin Dennis Cook; R II Timberland Partners 3. L.P.; and Virginia Theiss Marcus a/k/a Virginia Ella Mae Marcus, James Edward Marcus and Michael Lawrence Marcus to Mid -South Electric Cooperative so that Mid -South Electric Cooperative can provide electrical service to the mainline valves installed on the water pipeline within the easements is hereby authorized and the Mayor or City Manager of the City of Huntsville are hereby authorized to execute the appropriate assignment documents in behalf of the City of Huntsville. SECTION 2: That this Resolution shall become effective from and after the date of its passage. PASSED AND APPROVED ON THIS 21' DAY OF SEPTEMBER, 1999. William B.
