A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, APPROVING THE ABANDONMENT OF A
CERTAIN UTILITY RIGHTS -OF -WAY ACROSS PROPERTY
OWNED BY HUNTSVILLE MEMORIAL HOSPITAL;
AUTHORIZING THE MAYOR TO EXECUTE THE REQUIRED
INSTRUMENTS TO EFFECTUATE THE ABANDONMENTS; AND
DECLARING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS:
SECTION 1: That the City of Huntsville's interest in the sewer easement as
described in Exhibit "1" attached hereto and incorporated herein are hereby abandoned,
quitclaimed, and released by the City of Huntsville, Texas, and the Mayor of the City of
Huntsville, Texas is authorized to execute on behalf of the City of Huntsville all instruments
necessary to effectuate this abandonment.
SECTION 2: That this Resolution shall be effective from and after the date of its
passage.

KNOW ALL MEN BY THESE PRESENTS:
That the CITY OF HUNTSVILLE, TEXAS ( "City") acting herein by its duly authorized
Mayor, for ONE DOLLAR ($1.00) and other good and valuable consideration, the receipt of which is
hereby acknowledged, does hereby abandon, quitclaim and release all of the City's right, title and
interest to the following easements:
1. A Sanitary Sewer Easement of approximately 0.054 acres (2,347 square feet) located
in the Peter Tumlinson Survey, Abstract No. 539, City of Huntsville, Walker County,
Texas, as fully described on Exhibit "1" as Parcel 1, and being a part of Segment "C"
shown on Exhibit "2" and
2. A Sanitary Sewer Easement of approximately 0.074 acres (3,249 square feet) located
in the Peter Tumlinson Survey, Abstract No. 539, City of Huntsville, Walker County,
Texas, as fully described on Exhibit "1" as Parcel 2, and being all of Segment "D"
shown on Exhibit "2 ".
With all and singular the City's right, title, interest, estate, claim and demand in and to the easements
listed above so that neither the City nor its successors or assigns shall have any right, title, or interest in
such properties or premises, or any part thereof, at any time hereafter.

3.894 AC., PETER TUMLINSON SURVEY, A -539, WALKER COUNTY, TEXAS
A portion of a 10 foot wide right -of -way for a sewer line situated in the PETER
TUMLINSON SURVEY, Abstract No. 539, Walker County, Texas described in an Easement
from the Walker County Hospital District, the W.T. Robinson Company and the H.Y.
Robinson Company to the City of Huntsville June 8, 1978 and recorded in Volume 322, page
256, Deed Records of Walker County, Texas, and being all of said Easement lying within a
called 3.894 acre tract described in a Deed from the H.Y. Robinson Company, et al to the
Huntsville Memorial Hospital dated June 1, 1998 and recorded in Volume 352, page 365,
Official Public Records of Walker County, Texas, that portion of said Easement to be
abandoned being described in two parcels as follows:
PARCEL 1: A portion of Segment "C" of said Easement described as follows:
BEGINNING at the most northerly terminus of the centerline of said Segment "C"
and the most southerly terminus of the centerline of Segment "D" as described in said
Easement;
THENCE S 00* 19'E, a distance of 41.9 feet;
THENCE S 29.02'W, a distance of 192.81 feet to the intersection of the centerline of
said Easement Segment "C" with the southeast line of said Huntsville Memorial Hospital
3.894 acre tract; and
PARCEL 2: All of Segment "D" of said Easement.
