RESO 2002-39 - Affordable HousingRESOLUTION NO. 2002-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, FINDING A PUBLIC PURPOSE FOR THE SALE OF CITY -OWNED LOTS FOR LOW OR MODERATE- INCOME HOUSING; AUTHORIZING THE CITY MANAGER TO SELL THE LOTS TO SUSTAINABLE BUILDERS GUILD OF HUNTSVILLE, INC.; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Huntsville purchased property in the 900 block of Avenue H in order to contract with a non profit corporation for the construction of low and/or moderate - income housing; and WHEREAS, the City Council finds that there is a great need for low or moderate - income housing within the City; and WHEREAS, S ustainable B uilders G uild o f Huntsville, Inc. (SBGH) is a T exas Non Profit Corporation created to provide low and moderate - income housing in Huntsville and Walker County; and WHEREAS, the City Council finds that it would be appropriate to sell the property that the City owns in the 900 block of Avenue H to SBGH in order for the construction of low and/or moderate - income housing; and WHEREAS, t he C ity C ouncil s pecifically finds t hat i t w ould b e appropriate t o sell this property at less than its fair market value in order to provide such housing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: The property owned by the City of Huntsville, Texas in the 900 block of Avenue H should be sold to Sustainable Builders Guild of Huntsville, Inc. for the purpose of constructing low and/or moderate - income housing and selling the same to qualified purchasers, and the City Manager is authorized to negotiate and enter into an agreement with Sustainable Builders Guild of Huntsville, Inc. for the sale of said property under terms and conditions agreed to by the City Manager on behalf of the City of Huntsville and which will provide low and/or moderate - income housing within the City. SECTION 2: This Resolution shall become effective from and after the date of its passage. PASSED AND APPROVED THIS 17TH DAY OF DECEMBER 2002.
