ORD 1981-58 - Taxicab RatesORDINANCE NO. 81 -58 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 16, TAXICABS, OF THE CODE OF ORDINANCES TO ALTER THE RATES AND FARES PERMITTED TO BE CHARGED FOR TAXICAB SERVICE; MAKING OTHER PROVISIONS RELATED THERETO; PROVIDING A PENALTY OF UP TO $200.00; PROVIDING A SEVERABILITY AND A REPEALING PROVISION; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS that; Section 1: Chapter 16, Taxicabs, of the Code of Ordinances of the City of Huntsville, Texas is hereby amended by the repeal of Section 16 -39 as presently constituted and by the adoption of new Section 16 -39 that shall read as follows: Section 16 -39. Rates and Fares. (a) No owner or driver of a taxicab shall charge a greater sum for the use of a taxicab than in accordance with the following rates: The fare for one or more passengers picked up from the same or different points, whether delivered to the same or different destination, shall be: (1) $1.20 for the first 1/6 mile; (2) $1.20 for each mile thereafter; (3) Waiting Time: $12.60 per hour. No extra charge shall be made for baggage or parcels the size of which permits them to be carried in the cab. (b) A current schedule of all rates and fares charged by the holder shall always be on file with the City Secretary. The holder may from time to time propose changes in those rates and fares with the City Secretary for consideration of the City Council and left on file for a period of thirty (30) days. If, within that period, the same have been approved or have not been acted upon by the City Council, in whole or in part, the whole or part so approved, or so not acted upon shall take effect, as proposed; provided, however, said City Council shall have the right, by resolution duly passed, to extend the time for action upon such proposed changes in rates or fares for a reasonable time and, in such case, the City Council shall give the holder notice of having ordered such extension prior to the end of said thirty (30) day period. Any holder of a permit who deviates from the rates as approved by the City Council shall be subject to having the permit as issued by the City of Huntsville cancelled and said holder of said cancelled permit shall not be allowed to secure another permit without approval of said City Council. Section 2: Any person, firm or corporation violating any provision of this Ordinance or failing to comply with any requirement of this Ordinance will be guilty of a misdemeanor and subject to a fine of up to two hundred ($200.00) dollars upon conviction. Each day during or upon which said person shall violate or continue violation of any provision of this Ordinance or non - compliance with any requirement of this Ordinance shall constitute a distinct and separate offense. The violation of any provision of this Ordinance or the failure to comply with any requirement of this Ordinance shall each constitute a distinct and separate offense. Section 3: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this Ordinance. Section 4: All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other Ordinances regulating and governing the subject matter covered by this Ordinance. Section 5: The City Secretary is hereby directed to cause the caption of this Ordinance to be published at least one time within twenty days.
