ORD 1981-46 - Establish Planning CommissionUWINANCE NO. 61-45 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ESTABLISHING J PLANNING COmMISSION; DEFINING THE FUNCTIONS, POWERS AND DUTIES OF TUE PLANNING COMMISSION; REPEALING ORDINANCES INCONSISTENT HEREWITH; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO. WHEREAS, the City of Uuntsville, Texas desires to develop and maintain a Comprehensive Plan; and WHEREAS, the City desires to regulate the subdivision of real estate; NOW TUEREFORE, Bt.. IT Oid)A1NUD oZ rhz CITY COUNCIL OF 1iE CIIZ OF HUNTbVILLL, TUAA., that: Section 1: The Code of Ordinances of the City of Uuntsville, Texas, is hereby amended by the adoption of a new Chapter 3, Community Development, tnat shall read as follows: Chapter 3b. Community Development. Article I. City Plarininy Commission. Section 31J-1. Plannin Commission - Creation, Appointments, MembershGs*. (a) Tnere snail be a City Planning Commission consisting of seven (7) members appointed by the mayor with approval of Council. members shall ue appointed duriny the month of October. Each member shall be a resident of the City. (b) The members of the Commission snail be identitieu by place numbers one (1) throuyh (7). Places one (1), two (2) and three (3) shall ue appointed for term of one year, places four (4) and five (5) shall be appointed for term of two years, and places six (6) dhu (7) shall be appointed for a term of three years. Thereafter, all members shall be appointed for a term of three (3) years. *Charter authorizes Mayor to remove any appointed officer. • 1 (c) Should a vacancy occur, the _Mayor, with approval of Council, shall appoint a person to complete the unexpired term of such position. Section 30 -2. meetings, Officers and Rules. (a)= The Commission shall gold regular meetings during the first week of every month. Special meetings may be held on call of the Chairman, the City Manager or by a majority of the Commission qualified. (b) The Commission shall elect a Chairman who shall serve as presiding officer of the board for a period of one year. 'I'lie Chairman shall have no veto Dower, but shall be entitled to vote in all matters considered by the Commission. (c) i'ne Director of Planning shall serve as ex officio secretary of the Commission and shall keep minutes, books, files and other records of the board and perforia such other duties as are incidental to his office. (d) Any four (4) voting members of the Commission present shall consititute a quorum to conduct business. Section 3i -3. functions, Rowers and Duties. The Planning Commission shall have the following responsibilities: (a) to advise the city in the preparation and maintenance of a Comprehensive Plan and related studies; (b) to advise the city in establishing criteria for platting of land; (c) to assist the city in conducting public hearings as may be required to gather information necessary for the drafting, establishment and maintenance of the Comprehensive Plan and ordinances and regulations related to it; (d) to approve or disapprove, with or without variances, all plats of subdivisions of land within the City and its extraterritorial jurisdiction as specifically provided by the subdivision or development ordinances of the City of Huntsville; (e) to initiate planniny concepts and recommend policies for guiding action affecting development in the City and its environs; (f) to perform other duties that may be specifically assigned to it by the city that may have a bearing on the preparation or accomplishment of the Comprehensive Plan. Section 2. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason neld invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this Ordinance. Section 3. All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this Ordinance shall be cumulative of other Ordinances regulating and governing the subject matter covered by this Ordinance. In particular, the planning and Zoning Commission Ordinance, adopted 3 -8 -1960, and Ordinance No. 77 -9, passed and approved by City Council on 6 -14 -1977, are repealed. Section 4.
