RESO 2004-20 - Accept TDHCA Owner-Occupied Housing Assistance Program grant RESOLUTION NO. 2004-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ACCEPTING A GRANT OF $500,000 FROM THE HOME INVESTMENT PARTNERSHIP PROGRAM OF THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS FOR THE OWNER OCCUPIED HOUSING ASSISTANCE PROGRAM, COMMITING MATCHING FUNDS AND CASH RESERVES, AND AUTHORIZING THE CITY MANAGER TO ACT AS THE CITY'S EXECUTIVE OFFICER AND AUTHORIZED REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE CITY'S PARTICIPATION IN THE HOME PROGRAM. WHEREAS The City desires to develop a viable community for all citizens, and certain housing conditions exist which represent a threat to the health and safety of these households; and WHEREAS It is necessary and in the best interests of the City to accept funding under the 2004 HOME Program. NOW,THEREFORE, be it resolved by the City Council of the City of Huntsville, Texas, that: SECTION 1: A HOME Program application was filed on behalf of the City with the Texas Department of Housing and Community Affairs for funding under the Owner Occupied Housing Assistance program. SECTION 2: The City has been awarded $500,000 in grant funds to carry out the HOME Program. SECTION 3: The City of Huntsville shall contribute $100,000 in Cash Match and $25,000 of In-Kind Match, consisting of tap and permit fee waivers, provision of demolition labor, equipment and disposal fees for housing units assisted through this program. SECTION 4: The City of Huntsville shall make $250,000 available for Cash Reserves to be used as interim working capital for this HOME project. SECTION 5: The City Council directs and designates the City Manager as the City's Chief Executive Officer and Authorized Representative to act in all matters in connection with this application and execution of the HOME Agreement. The Department must ensure that pressing statewide housing needs are met in accordance with federal and state guidelines. The Department must also ensure that programs perform in a timely manner to ensure that funds are expended according to the terms agreed to at the time of the award. The Department is allowing no more than one extension of a contract for a total of six months, absent special circumstances. Projects in process at the end of the contract cannot be reimbursed and contracts will not be extended beyond the six months unless, in rare cases, approved by the Department Governing Board. Failure to comply with program requirements will affect funding on current contracts and eligibility for future awards. The Department appreciates your participation in the HOME Program. Support documentation evidencing the match contribution must be submitted by Administrator upon request for disbursement of funds for each project assisted, in accordance with 24 C.F.R. Part 92 and the HOME Program Policies and Procedure Manual. ADMINISTRATION Administrator may expend funds provided under this contract for reasonable administrative and planning costs directly related to this contract in accordance with Sections 3, 4, and 5 of this contract and 24 C.F.R Sec. 92.207 in an amount that is not more than four percent (4%) or Sixteen Thousand One Hundred Eleven and No/100 Dollars ($16,111.00), of the total amount of project funds received under this contract. Administrator shall be allowed to draw up to ten percent (10%) of the actual allowable administrative costs incurred at the initial state of the contract, with the remaining ninety percent (90%) funded on a pro rata basis,based on draws.
