A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, IN
SUPPORT OF REMOVING STATE HIGHWAY SPUR NO. 94 FROM THE STATE HIGHWAY
SYSTEM;AND DECLARING AN EFFECTIVE DATE.
WHEREAS, S tate H ighway S pur N o. 9 4 w as a dded t o t he s tate h ighway s ystem b y T exas H ighway
Commission Minute Order No. 017298, dated May 9, 1940; and
WHEREAS, said State Highway Spur No. 94 goes from a point on US 190 in Huntsville, Texas to the
gate of the cemetery where General Sam Houston is buried; and
WHEREAS, the State has maintained this roadway as a state highway since its addition tot he state
highway system; and
WHEREAS,this section of roadway is functionally classified as a minor collector; and
WHEREAS, the Texas Department of Transportation is in the process of developing the plans,
specifications and estimate (PS&E) for a highway improvement project to rehabilitate this section of
roadway an enhance its appearance by constructing selected landscaping and other aesthetic treatments;
and
WHEREAS, the State and the City of Huntsville have agreed in principal to remove this section of
highway from the state highway system and return it to the ownership of the City of Huntsville upon the
completion and acceptance of this highway improvement project in accordance with PS&E; and
WHEREAS, a minute order must be prepared and adopted by the Texas Transportation Commission to
remove State Highway Spur No. 94 from the state highway system;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE,TEXAS,THAT:
Section 1. The City of Huntsville has no objection to the easement and right-of-way for State
Highway Spur No.94 to the City of Huntsville for the City to own, maintain and operate
as a city street upon the completion and acceptance of the highway improvement project
by TXDOT in accordance with PS&E.
Section 2. This resolution shall become effective from and after the date of its passage.

Dear Mayor Turner:
In accordance with Resolution No. 2004-001 passed and approved by the City of Huntsville City
Council on January 13, 2004, the Texas Transportation Commission passed Minute Order
Number 110741 dated October 26, 2006, authorizing the removal of SP 94 (Avenue I) from the
state highway system. This facility is now returned to the City of Huntsville for its control,
jurisdiction and maintenance.
The City's help and cooperation was invaluable during development and construction of this
recently completed highway improvement project. Because of the efforts of members of the city
staff, I believe we were able to provide the City with a facility that will compliment the aesthetic
and historical aspects of the area.

In WALKER COUNTY(county)in the city of Huntsville(city),city officials have requested
the removal of STATE SPUR 94 from the state highway system. The city would like to incorporate
the roadway into its street system and has requested control,jurisdiction,and maintenance of
State Spur 94.
Pursuant to Texas Transportation Code, §§201.103 and 221.001,the executive director has
recommended that State Spur 94 be removed from the state highway system and returned to the city.
IT IS THEREFORE ORDERED by the Texas Transportation Commission that State Spur 94
is removed from the state highway system from the intersection of US 190 northward to 0.2 mile
north of the intersection of US 190,a distance of approximately 0.2 mile,and returned to the city for
control,jurisdiction,and maintenance.
