ORD 2000-04 Municipal Court Fees - Permanent 02-08-2000 ORDINANCE NO. 2000-04 AN ORDINANCE OF THE CITY OF HUNTSVILLE,TEXAS,AUTHORIZING A THREE DOLLAR($3.00) SECURITY FEE AND A FOUR DOLLAR($4.00) TECHNOLOGY FEE AS A COST OF MUNICIPAL COURT; AND DECLARING AN EFFECTIVE DATE. WHEREAS,Art. 102.017 of the Texas Code of Criminal Procedure authorizes a municipality to create a municipal court building security fund and require a defendant convicted of a misdemeanor offense in the municipal court to pay a$3.00 security fee as a cost of court; and WHEREAS, Art. 102.0172 of the Texas Code of Criminal Procedure authorizes a municipality to create a municipal court technology fund and require a defendant convicted of a misdemeanor offense in the municipal court to pay a technology fee not to exceed $4.00 as a cost of court; and WHEREAS, the City Council of the City of Huntsville deems it appropriate to create a municipal court security fund and a municipal court technology fund and assess fees in accordance with state law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,TEXAS, that: SECTION 1: That a City of Huntsville Municipal Court security fund pursuant to the provisions of Article 102.017, Texas Code of Criminal Procedure, and a City of Huntsville Municipal Court Municipal Court technology fund pursuant to the provisions of Article 102.0172, Texas Code of Criminal Procedure are hereby established. Each defendant convicted of a misdemeanor offense in the City of Huntsville Municipal Court shall pay a municipal court security fee in the amount of Three Dollars ($3.00) and a municipal court technology fee in the amount of Four Dollars ($4.00) as a cost of court, and said fees shall be credited to the respective funds. The municipal court security fee and the municipal court technology fee shall be assessed as a cost of court on misdemeanor convictions for an offense committed on or after March 1, 2000. The costs of court credited to the City of Huntsville Municipal Court security fund shall only be used for the purposes enumerated in Article 102.017, and the costs of court credited to the City of Huntsville Municipal Court technology fund shall only be used for the purposes enumerated in Article 102.0172. The Director of Finance for the City of Huntsville shall provide appropriate accounting for the funds, and expenditures of said funds will be made pursuant to the City's rules, regulations and policies on the appropriation and expenditure of monies. The described funds shall be included in the City's General Fund and separate accounts established to reflect the receipts and disbursements of the monies. Interest earnings shall be credited to the appropriate fund. SECTION 2: This Ordinance shall become effective from and after the date of its passage. Isham, City Attorney I DATE: January 27, 2000 SUBJ: Ordinance, Security Fee and Technology Fee Attached please find a draft of an ordinance that creates a municipal court security fund and a municipal court technology fund and assesses a$3.00 and$4.00 court cost respectively. These costs were approved by the Council's Finance Committee at its meeting on January 25, 2000. I have worded the ordinance so that it will not require the City to establish separate accounts,but only keep tract of the monies separately. In other words,the monies can be deposited to the City's normal bank account similar to other revenues collected by the City,but there will be an accounting of those funds_ If you have any suggested changes to this ordinance,please provide said changes to me by February 2, 2000.
