ORD 1981-26 - Manufactured HomesORDINANCE NO. 81 -26 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ENFORCING MINIMUM STANDARDS FOR MANUFACTURED HOME (INCLUDING MOBILE HOMES) AND RECREATIONAL VEHICLE PARKS AND COMMUNITIES; ESTABLISHING REQUIREMENTS FOR THE DESIGN, CONSTRUCTION, ALTERATION AND EXTENSION OF MANUFACTURED HOME AND RECREATIONAL VEHICLE PARKS; AUTHORIZING THE ISSUANCE OF PERMITS FOR CONSTRUCTION, ALTERATION AND EXTENSION OF MANUFACTURED HOME AND RECREATIONAL VEHICLE PARKS; AUTHORIZING ISSUANCE OF PERMITS FOR CONNECTION OF MANUFACTURED HOME AND RECREA- TIONAL VEHICLES TO CITY UTILITIES; REGULATING PLACEMENT OF MANUFACTURED HOMES OUTSIDE MANUFACTURED HOME PARKS; PROVIDING A PENALTY UP TO $200.00 FOR VIOLATIONS; MAKING OTHER PROVSIONS RELATED TO THE SUBJECT MATTER; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: The Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the repeal of Chapter 11B, "Mobile Homes and Mobile Home Parks ", as presently constituted, and by the adoption of a new Chapter 11B, Manufactured Homes and Recreational Vehicles, that shall read as follows, to -wit: (See Exhibit "A" attached hereto and made a part hereof for all intents and purposes.) Section 2: Any person, firm or corporation who shall violate any of the pro- visions of this Chapter, or who shall fail to comply with same shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not exceeding two hundred dollars ($200.00). Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision or part of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their applica- tion to other persons or sets of circumstances and to the end all pro- visions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its publication. The City Secretary is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the City's official newspaper at least once within twenty (20) days after its final passage by City Council. Commission. The City's Planning Commission. b. Manufactured home. A trailer, vehicle, building, or structure, manufac- tured at a location other than the location where it is installed and used as a residence or office by a consumer, transportable in one or more sections on a permanent chassis, a temporary chassis, or other con- veyance device, and designed to be used as a dwelling unit or office, without a permanent foundation or when placed on a permanent foundation, when connected to required utilities. This term includes mobile homes and modular homes. CROSS REFERENCE Portable Buildings. Standard Building Code §§ 504, 2204 et seq. c. Manufactured home lot. A parcel or tract of land for the placement of a single manufactured home, not a manufactured home site. d. Manufactured home site. That part of a manufactured home park improved for the placement of a manufactured home. e. Manufactured home park. A tract or parcel of land used for rental occu- pancy by two (2) or more manufactured homes. f. Occupy. The use of a manufactured home as a residence or place of business. A presumption that a manufactured home or recreational vehicle is occupied will exist if it is connected to two or more utilities. g. Recreational vehicle (RV). A camp car, motor home, pickup coach, travel trailer, tent trailer or other portable structure, with or without motive power, designed and used for human habitation for recreational occupancy. h. RV Park. An area set aside and offered by any person for the parking and accommodation of two (2) or more recreational vehicles. 11B -2 Planning Commission The Planning Commission shall have the power to make and promulgate its own rules governing its meetings and proceedings, subject to the provisions of this chapter. 11B -3 Appeals Procedure. (a) Any license revocation or suspension, any order for a utility dis- connection, or any decision, order or action taken by the building official may be appealed by any person affected by the decision, order or action to the Commission by filing written notice of appeal within ten (10) days from the date of notice of such action by mailing postpaid or delivering such notice to the Director of Planning or Community Devel- opment, City Hall, Huntsville, Texas. When such a written appeal specifying the grounds therefor has been made within ten (10) days, a license suspension or revocation, or any decision or action by the building official will be held in abeyance and such person will be given a hearing before the Commission, provided, any utility discon- nection shall not be reconnected unless authorized by the Commission after a hearing. (b) Appeals to the Commission shall be set for hearing within fifteen (15) days from the date notice of appeal was received by the Chairman, whenever possible. Such hearings may be continued from time to time, until completed, but a final decision shall be made within thirty (30) days from the date notice of appeal was received by the Chairman, unless by consent or request of the person appealing a hearing is set for or continued beyond such thirty -day period. (c) The Commission shall the decision or action of a licensee, or any person ing official may appeal a City Council. have authority to affirm, modify or reverse the building official. The building official, who appeals a decision or action of the build - decision or action of the Commission to the (d) A license suspension, revocation, utility disconnection order, or other decision or action of the building official which has been upheld by the Commission shall be immediately effective, subject, however, to the right of the person affected thereby to appeal to the City Council. 11B -4 Enforcement of license; authority of building official to revoke or suspend. The building official shall have authority to suspend or revoke licenses or to order utility disconnections for the following violations of the pro- visions of this chapter: (a) A license may be suspended for any period of time up to six (6) months for a violation affecting the health, safety or welfare of occu- pants of a manufactured home or a RV vehicle or of other persons or property. (b) A license may be revoked for a violation which is dangerous to life. (c) A license may be revoked if the owner or operator intentionally or knowingly files an incomplete or inaccurate list of manufactured home owners as required at section 11B- 28(c)(7). (d) For a violation of the provisions of this chapter not deemed to require a license suspension or revocation, the utility connection servicing any site or sites, or any structure in a manufactured home park, may disconnected or cause to be disconnected, provided a utility disconnection may be ordered in connection with a license suspension or revocation as to all or any part of a manufactured home park if necessary to protect life or property. 11B -5 Penalty Any person, firm, or corporation who commits an offense under any pro- vision of this chapter, whether or not such violation shall be found sufficient for revocation of any permit or license, shall be punished by a fine of not more than $200.00. A person shall be deemed guilty of a separate offense for each and every day, or portion thereof, during which any violation of any of the provisions of this chapter is committed, continued, or permitted. ARTICLE II. Connection Permits (a) A person commits an offense if he connects to or allows any manu- factured home to be connected to any sewer, gas, water or electrical connection without first obtaining a connection permit therefor. (b) Connection permits shall be issued by the Building Official upon the payment of an inspection fee of Seven and 50/100 ($7.50) Dollars. Thereafter as soon as practical, the Building Official shall inspect the manfactured home for which said permit was issued and if found to be properly connected to sewer, gas, water and electrical connections in accordance with applicable codes and ordinances of the City of Huntsville, including this chapter, he shall issue an inspection ap- proval tag or sticker for affixing to the manufactured home inspected. Such tag or sticker shall be displayed upon the front portion of said manufactured home in such a manner as to be easily seen and shall remain so displayed so long as said manufactured home remains connected to sewer, gas, water or electrical connections. (c) All applications for such connection permits shall be made upon forms provided by the Building Official and shall contain the name of the manufactured home owner, his mailing address, and a description of the manufactured home for which said application is made. (d) When any manufactured home is disconnected from sewer, gas, water or electrical connections and removed from any manufactured home park, the Building Official shall be informed so that the records pertaining to the inspection made under the permit issued for such manufactured home may be removed from the active files maintained by the Building_ Official. (e) The Building Official shall inspect manufactured homes from time to time and he is hereby authorized to require corrective action upon the part of the occupant or owner of any manufactured home found to be improperly connected to sewer, gas, water or electrical connections. In the event any occupant or owner fails to comply with the corrective action required within three (3) days after notice thereof, the Building Official shall cause the termination of sewer, gas, water or electrical service in the interest of the safety, health and welfare of the public until the deficiency is corrected. ARTICLE III. Manufactured Home Parks DIVISION A. 11B -21 Permit for Construction Required (a) A person commits an offense if he constructs, alters, or extends a manufactured home park without a written permit from the City. (b) Ordinary minor repairs may be made with the approval of the Building Official without a permit; provided that such repairs shall not violate any of the provisions of this chapter. 11B -22 Permit Application; Issuance The application for permit shall be made to the City Permit Officer and shall contain the following: (a) name and address of the applicant; (b) location and description of the manufactured home park; (c) engineering plans and specifications of the proposed park showing (1) area and dimensions of the tract of land; (2) a plat or map of the proposed manufactured home park showing the number, location and size of all manufactured home sites, widths of roadways and walkways, service buildings and other proposed structures; (3) the location of water and sewer easements, lines and riser pipes; (4) the refuse and sewage disposal systems; (5) electrical and lighting systems. (d) A separate permit shall be required for building, plumbing, elec- trical work, curb cuts. (e) The failure of said application to meet any item described shall be sufficient reason to deny issuance of a manufactured home park con- struction permit. (f) Upon approval of park plans and specifications by City Engineer, Building Official and City Health Officer, a permit for the manufactured home park will be issued by Building Official's office. 11B -23 Manufactured Home Park Standards (a) Drainage (1) Condition of soil, ground water level, drainage, and topography shall not create hazards to the property or the health or safety of the occupants. The site shall not be exposed to objectionable adverse influences, and no portion subject to unpredictable and /or sudden flooding or erosion shall be used for any purpose which would expose persons or property to hazards. (2) Exposed ground surfaces in all parts of every manufactured home park shall be paved, or covered with stone screenings, or other solid material, or protected with a vegetable growth that is capable of preventing soil erosion and of eliminating dust. (3) The ground surface in all parts of every manufactured home park shall be graded and equipped to drain all surface water in a safe, efficient manner. (b) Residential use (1) No part of any park shall be used for nonresidential purposes, except such uses that are required for the direct servicing and well -being of park residents and for the management and mainten- ance of the park. (2) Nothing contained in this section shall be deemed to prohibit the sale of a manufactured home located on a manufactured home site and connected to the utilities. (c) Recreational area (1) In all parks accommodating or designed to accommodate twenty - five (25) or more manufactured homes, there shall be not less than one recreation area which shall be easily accessible to all park residents. (2) The size of such recreation areas shall be based upon a mini- mum of one hundred (100) square feet for each manufactured home site. No outdoor recreation area shall contain less than two thousand five hundred (2,500) square feet. (3) Recreation areas shall be so located as to be free of traffic hazards and should, where the topography permits, be centrally located. (d) Setbacks, buffers, and spacing. (1) All manufactured homes shall be located at least ten (10) feet from any property boundary line abutting upon a public street or highway and at least five (5) feet from interior property boundary lines. (2)(a) There shall be a minimum distance of twenty (20) feet between individual manufactured homes, and between manufactured homes and other permanent structures, and four (4) feet from adjoining pavement of a park street, or common parking area, or other common areas. (b) An accessory structure which has a horizontal area exceed- ing twenty -five (25) square feet, is attached to a manufactured home or located within ten (10) feet of its window, and has an opaque top or roof that is higher than the nearest window, shall, for purposes of all separation requirements, be considered to be part of the manufactured home. (3) All manufactured home parks located adjacent to industrial, commercial, or residential land uses shall be provided with screen- ing such as fences or natural growth along the property boundary lines separating the park and such adjacent uses. (CROSS REFERENCE: SETBACKS 6B -4) (e) Private streets. (1) All manufactured home parks shall be provided with safe and convenient vehicular access from abutting public streets or roads to the internal parking area or manufactured home site. Alignment and gradient shall be properly adapted to topography. (2) Access to manufactured home parks shall be designed to minimize congestion and hazards at the entrance or exit and allow free move- ment of traffic on adjacent streets. The entrance road connecting the park streets with a public street or road shall have a minimum road surface width of thirty -four (34) feet where parking is per- mitted on both sides, or a minimum road surface width of twenty - seven (27) feet where parking is limited to one side. Where the primary entrance road is more than one hundred (100) feet long and does not provide access to abutting manufactured home lots within such distance, the minimum road surface width may be twenty -five (25) feet, provided parking is prohibited at both sides. (3) Surfaced roadways shall be of adequate width to accommodate anticipated traffic and in any case shall be not less than twenty - five (25) feet in width. (4) Dead -end streets shall not exceed one thousand (1,000) feet in length. Such streets shall be provided with a turnaround at the closed end and have an outside roadway diameter of at least sixty (60) feet. (5) All streets shall be provided with a smooth, all- weather sur- face which shall be durable and well drained under normal use and weather conditions. Street surfaces shall be maintained free of dust, cracks, holes, and other hazards. (6) Street and intersection design shall conform to City Geometric Standards for residential development. (CROSS REFERENCE: Subdivision Ordinance (f) Lighting. All manufactured home parks shall be furnished with lighting units so spaced and equipped with luminaries placed at such mounting heights as will provide the following average maintained levels of illumination for the safe movement of pedestrians and vehicles at night: (1) All parts of the park street system shall average three - tenths (0.3) foot - candles and no part shall have less than one -tenth (0.1)foot- candle. (2) Potentially hazardous locations, such as major street inter- sections and steps or stepped ramps shall be individually illuminated and shall have a minimum of three - tenths (0.3) foot candles. (CROSS REFERENCE: CITY STREET LIGHTING POLICY.) (g) Off - street parking. (1) Off - street parking areas shall be provided in all manufactured home parks for the use of park occupants and guests. Such areas shall be furnished at the rate of not less than two spaces for each manufactured home site, each space to be ac- cessible without moving another car. (2) Required car parking spaces shall be so located as to provide convenient access to the manufactured home, but shall not exceed a distance of two hundred (200) feet from the manu- factured home that it is intended to serve. (CROSS REFERENCE: OFF- STREET PARKING ORDINANCE) (h) Easements. Each space or site shall abut utility easements dedicated to the City sufficient to provide adequate water and sewer service. (i) Water. (1) An accessible, adequate, safe, and potable supply of water shall be provided in each manufactured home park. Where a public supply of water of satisfactory quantity, quality, and pressure is available, connection shall be made thereto and its supply used exclusively. When a satisfactory public water supply is not available, a private water supply system may be developed and used as approved by the health authority. A private water supply system shall comply with the require- ments of the plumbing code for the City of Huntsville and State of Texas Department of Health. Each manufactured home shall be individually metered by a water meter provided by the City under Chapter 17 of the Code of Ordinances. (2) The water piping system shall not be connected with non- potable or questionable water supplies and shall be protected against the hazards of backflow or back siphonage. (3) The system shall be so designed and maintained as to provide a pressure of not less than 20 pounds per square inch, under normal operating conditions at service buildings and other locations requiring potable water supply. (4) Individual water riser pipes shall be located within the con- fined area of the manufactured home site at a point where the water connection with approximately a vertical position. Water riser pipes shall extend at least four inches above ground elevation and be at least three - quarter inch. Each pipe shall be thoroughly cleaned prior to the connection of a new manu- factured home. (5) Adequate provisions shall be made to prevent freezing of service lines, valves and riser pipes and to protect risers from heaving and thawing action of ground during freezing weather. (6) Underground stop and waste valves shall not be installed on any water supply. (7) All water piping, fixtures and other equipment shall be con- structed and maintained in accordance with state and local regulation and requirements and shall be of a type and in locations approved by the City of Huntsville Plumbing Inspector. (j) Sewage Disposal. (1) An adequate and safe sewerage system shall be provided in all manufactured home parks or trailer parking areas for conveying and disposing of all sewage; where an approved public system is available, a park system will not be developed. Such. system shall be designed, constructed and maintained in accordance with state and local laws and will be approved by the appro- priate health agency and City Inspection Office. Such system shall provide for each manufactured home to be served by an individual sewer tap. (2) All sewer lines shall be located in trenches of sufficient depth to be free of breakage from traffic or other movement and shall be separated from the park water supply system at a safe distance. Sewers shall be at a grade which will insure a velocity of two feet per second when flowing full. All sewer lines shall be constructed of materials approved by the City Plumbing Code and shall be vented at proper intervals and shall have watertight joints. (3) The sewer riser shall have at least a four inch diameter, shall be trapped below ground surface and shall have the proper clean out and overflow protector. (See diagram 2 -A for details) (4) When a manufactured home site is not occupied, the sewer pipe must be capped. The rim of the pipe must be at least four inches above ground elevation. (See diagram 2 -A for details) (5) Installation of all risers, underground traps, septic tank and drain fields will be accomplished under the supervision of a plumber licensed by the State of Texas. (6) See detail section of manual for additional information on plumbing, etc. (k) Electrical Distribution System (1) Every park shall contain an electrical wiring system consist- ing of wiring, fixtures, equipment and appurtenances which shall be installed and maintained in accordance with applicable codes and regulation governing such system. All installation work or electrical fixtures will be accomplished in accordance with the rules of the National Electrical Code current edition. (2) Each manufactured home site shall be provided with an approved disconnecting device and overcurrent protective equipment. The minimum service per outlet shall be 120/240 volt AC, 100 amperes. (See diagram 1 -B for details) (3) All electrical wiring, installation of repair of electrical services shall be done by a licensed and bonded electrician by the City of Huntsville, Texas. (1) Refuse handling (1) The storage, collection and disposal of refuse in the manu- factured home park shall be so conducted as to create no health hazards, rodent harborage, insect breeding areas, accident or fire hazards or air pollution (see Code of Ordinances and other ordinances for specific requirements). (2) A refuse pickup easement shall be granted to the City if refuse disposal facilities are located so as to require the entrance of a municipal vehicle into the trailer park. (m) Fuel Supply (1) Natural gas systems: a. Natural gas - piping systems shall be installed and main- tained in accordance with the building code and other regulations governing such systems. b. Each manufactured home site provided with piped gas shall have an approved manual shut -off valve installed upstream of the gas outlet. The outlet shall be equipped with an approved cap to prevent accidental discharge of gas when the outlet is not in use. (2) Liquefied petroleum gas systems: Liquefied petroleum gas systems shall be installed and maintained in accordance with applicable laws, ordinances and regulations governing such systems. Bulk storage and distribution system plans shall be submitted to the Fire Marshal for approval. (3) Fuel oil supply systems: a. All fuel oil supply systems shall be installed and main- tained in accordance with applicable laws, ordinances, and regulations governing such systems. b. Storage tanks located in areas subject to traffic shall be protected against physical damage. (n) Fire protection (1) No manufactured home park may be located within the fire zone of the City. (2) Manufactured home parks shall be kept free of litter, rubbish and other flammable materials. (3) Portable fire extinguishers of a type approved by the Fire Marshal shall be kept in service buildings and all other locations designated by the Fire Marshal or Fire Inspectors, and such extinguishers shall be maintained in good operating condition. (4) Fire hydrants shall be located within five hundred (500) feet of any manufactured home, service building or other structure in the park. Fire hydrant locations shall be determined by the Fire Marshal. Co) Density No more than seven (7) manufactured home sites shall be situated per acre of unimproved land. By "unimproved land" it is meant land upon which no roadways, sidewalks, or other type improvements have been constructed. In addition to this requirement, all space and distance requirements as elsewhere herein set out shall be ob- served and complied with so that in the enforcement of this density requirement the more restrictive of the two (2) standards shall be applied in any situation to determine compliance with this section. (p) Off -site improvements (1) When the development of a manufactured home park will result in an increased burden on improvements which will serve it, but are located off the immediate site, provision shall be made to cover the cost of such improvements before the con- struction permit is finally approved. (2) Prior to the approval of such permit, the applicant shall make provision for payment of such cost, as follows: Where the improvements can be put in immediately, the cost shall be covered in the improvement bond furnished by the applicant or the improvement shall be installed prior to approval of the permit. If the cost consists of the expense of installing additional sizes of water pipes, or sewer pipes which are not yet installed, a sum estimated by the Commission to be suffi- cient for the purpose shall be deposited in a special fund. This fund shall be held by the City Finance Director and used together with any interest earned by the fund solely to pay a pro rata cost of the improvement based upon the excess of cost to provide for the additional ser- vice necessitated by the manufactured home park. (3) Off -site improvements herein shall include, but not be limited to, installation of new improvements and extensions and modifi- cations of existing improvements. The allocation of costs shall be determined in accordance with the following: The Commission may consider the total cost of the off -site improvements, the benefits conferred upon the manufactured home park, the needs created by the manufactured home park, population and land -use projections for the general areas of the manufactured home park, and other areas to be served by the off - site improvements, the estimated time of construction of off - site improvements, and the condition and periods of usefulness. (4) Road, curb, gutter and sidewalk improvements may be based upon the anticipated increase of traffic generated by the manufactured home park. In determining such traffic increase, the Commission may consider traffic counts, existing and projected traffic patterns, quality of roads and sidewalks in the area, and other factors related to the need created by the manufactured home park and the anticipated benefit thereto. (5) Drainage facilities shall be based upon and determined by the drainage created by or affected by a particular project and considering: a. The percentage relationship between the manufactured home park acreage and the acreage of the total drainage basin; b. The use of a particular site; c. The amount of area to be covered by impervious surfaces on the site itself; d. The use, condition or status of the remaining area in the drainage basin. 6) Water supply and distribution facilities may be based upon the added facilities required by the total anticipated water - use requirements of the manufactured home park. 11B -24. Existing Manufactured Home Parks. (a) Except for subsections (b) and (c) of this section, all existing manufactured home parks and all manufactured home parks subse- quently annexted by the City shall have twelve (12) months to comply with the standards of this Chapter; provided, however, that no such park shall be required to comply with the following standards: 1. 11B -23(b) 2. 11B -23(c) 3. 11B -23(d) 4. 11B -23(e) 2, 3, 4, 6 5. 11B -23(f) 6. 11B -23(g) 7. 11B -23(h) 8. 11B- 23(i)(1) last sentence only 9. 11B- 23(j)(1) last sentence only 10. 11B- 23(k)(2) 50 amp only 11. 11B- 23(n)(4) 12. 11B -23(o) 13. 11B -23(p) (b) If, within any twelve (12) month period, alterations or repairs costing in excess of fifty (50) percent of the then physical value of the manufactured home park are made to the park, such park shall be made to conform to the requirements of this Chapter. (c) A person commits an offense if he alters or repairs an existing manufactured home park in such a manner as to increase an existing non - conformity or hazard. DIVISION B. 11B -25. License Required A person commits an offense if he operates or maintains a manufactured home park without a license from the City. 11B -26. License Application; Issuance. Application for a manufactured home park license shall follow the same procedure as any other new construction as follows: (a) The name and address of the applicant; (b) The location and legal description of the manufactured home park; (c) A complete site plan showing location of streets, manufactured home sites, sidewalks, sewer, gas and water lines and proposed installation, electrical service and disconnect location for each site; (d) Plans and specifications of all buildings and other improvements constructed or to be constructed within the manufactured home park; (e) Such further information as may be requested by the City Engineer's office as boundary lines, survey, plot diagram drawn to engineer's scale, private sewer disposal system. (f) Upon approval of plans and specification by City Engineer, Building Official and City Health Officer, license for above manufactured home park will be issued by City Inspector's office. (g) Cost of license shall be issued on a pro rata basis so as to renew same as of January 15 of the following year. 11B -27. License Fee Effective January 1, 1982, the annual license fee for each calendar year for each manufactured home park shall be Twenty -five Dollars ($25.00), plus One Dollar ($1.00) for each lot or area in such manufactured home park main- tained for rental space for a manufactured home. Such fee shall be paid no later than January 15, 1982, and no later than January 15th of each succeed- ing year thereafter so long as such manufactured home park is operated as such. 11B -28. Management and maintenance of manufactured home park (a) Each manufactured home park shall be under the direct management of the owner or his agent or representative for whose acts he or they shall be fully responsible. The name of the person entrusted with the direct management of a park shall be filed for reference with the City Inspection office. (b) Every person owning or operating a manufactured home park shall maintain such park and its facilities, fixtures and equipment in a sanitary condition and in a state of good repair. (c) It shall be the duty of the owner, his agent, representative or manager to prescribe rules and regulations for management of the park; to make adequate provisions for the enforcement of such rules; and to subscribe to any and all subsequent rules and regulations which may be adopted for the management of such park. In addition thereto, it shall be the duty of the owner, his agent, representa- tive or manager to comply with the following: (1) Provide for regular inspection of water and sanitary conven- iences; (2) Provide for the collection and removal of garbage and other waste materials; (3) Prohibit the placing or storage of unsightly material or vehicles of any kind; (4) Provide for the regular cleaning, painting, repairing and disinfecting of all units as needed; (5) Take such other measures as may be deemed to be necessary by the City of Huntsville to preserve the health, comfort and safety of all persons residing in the park and the general public; (6) Report immediately to the Police Department of the City of Huntsville all acts of disorderly conduct committed by any person or persons inside the park; (7) The name and mailing address of every tenant of the park. MANUFACTURED HOME SUBDIVISIONS See Subdivision Ordinance ARTICLE V. MANUFACTURED HOMES OUTSIDE PARK 11B -41 Deed Restrictions Applicable No manufactured home shall be parked or erected in violation of any enforceable deed restriction or covenant. 11B -42 Permits Required All manufactured homes located outside manufactured home parks for more than forty -eight (48) hours shall be connected to all required utilities and, in addition to the connection permit required by Article II hereof, permits shall be obtained from the city permit official for a foundation, driveway, electricity, etc. 11B -43 Minimum Lot Size (a) A manufactured home may be placed outside a park provided it is placed on a lot or tract of property with more than 6,000 square feet of land. (b) No manufactured home shall be parked or erected within ten (10) feet of another building. (CROSS REFERENCE SET BACK LINES) 11B -44 Water and Sewer Connections Manufactured homes located outside manufactured home parks will be con- nected by separate and individual water and sewer taps to city services where such services are available. 11B -45 Flood Hazard Areas (CROSS REFERENCE: SEC. 6 -16 FLOOD HAZARD AREA REGULATIONS) 11B -46 Off Street Parking Two (2) off - street spaces shall be provided for each manufactured home. Each space shall be accessible without moving another car. (CROSS REFERENCE: Off Street Parking Ordinance) 11B -47 Access to Public Street All manufactured homes shall be provided with safe and convenient access from parking area to public streets. ARTICLE VI. RV PARKS DIVISION A. 11B -51 Construction Permit Required A person commits an offense if he constructs, extends or alters a RV park without a written permit from the City. 11B -52 Permit Application; Issuance The application for permit shall be made to the City Permit Officer and shall contain the following: (a) name and address of the applicant; (b) location and description of the RV Park; (c) Engineering plans and specifications of the proposed park showing (1) area and dimensions of the tract of land; (2) a plat or map of the proposed RV park showing the number, location, and size of all RV sites, widths of roadways and walkways, service buildings and other proposed structures; (3) the location of water and sewer easements, lines and riser pipes; (4) the refuse and sewage disposal systems; (5) electrical and lighting systems. (d) A separate permit shall be required for building, plumbing, elec- trical work, curb cuts; (e) The failure of said application to meet any item described shall be sufficient reason to deny issuance of a RV park construction permit. (f) Upon approval of park plans and specifications by City Engineer, Building Official and City Health Officer, a permit for the manufactured home park will be issued by Building Official's office. 11B -53 Construction Standards (a) Drainage RV park shall be located on a well drained site, susceptible to quick drying. (b) Space and Layout (1) The area of the RV park shall be large enough to accommodate the designated number of RV sites, necessary streets and roadways, and parking areas for motor vehicles. (2) Each RV trailer site shall contain a minimum of twelve hundred (1200) square feet. (3) The density shall not exceed twenty -five (25) recreational vehicles per acre. (4) All recreational vehicles shall be separated from each other from other structures by at least ten (10) feet. (5) All recreational vehicles shall be located at least five (5) feet from any property line of the RV park. (6) All recreational vehicles shall be located at least twenty - five (25) feet from any public street or highway. (7) Convenient access shall be provided to and from public streets. (8) Roadways shall be all- weather surfaced of adequate width to accommodate anticipated traffic and shall meet the following minimum requirements: (a) One -way, no parking, 11 feet wide, only if less than 500 feet long and serving less than 25 spaces; (b) One -way, parking only on one side, 18 feet wide, only if serving less than 50 spaces; (c) Two -way, no parking, 20 feet wide; (d) Two -way, parking only on one side, 27 feet wide; (e) Two -way, parking on both sides, 34 feet wide. (9) Each RV site shall provide sufficient parking and maneuvering space so that the parking, loading, or maneuvering of recrea- tional vehicles incidental to the parking shall not necessitate the use of any public street, sidewalk or right -of -way. (c) Water Supply (1) An easily accessible water supply outlet for filling RV water storage facilities shall be provided for every 25 sites. (2) All water supply outlets shall consist of at least a water hydrant and the necessary appurtenances and shall be protected against the hazards of backflow and siphonage. (d) Sewage Disposal (1) The sewage system shall be designed to accommodate a minimum of three persons per site per day. (2) At least one sanitary station consisting of at least a trapped four -inch sewer riser pipe, connected to the RV park sewage system, surrounded at the inlet end by a concrete apron sloped to a drain, and provided with a suitable hinged cover; and a water outlet with the necessary appurtenances, properly pro- tected from backflow or siphonage, to,permit washdown of the immediate adjacent areas shall be provided for each 25 sites. A sign shall be erected to indicate water at this location is not for consumption or filling storage tanks. (e) Toilet facilities RV parks shall provide a public toilet, consisting of lavatory, toilet and shower accommodating one person of each sex for every twenty sites. (f) Electrical hookups Electrical service receptacles shall be located within twenty -five (25) feet of each recreational unit. DIVISION B 11B -54 License Required A person commits an offense if he operates or maintains a RV park without a license from the City. 11B -55 License Application; Issuance. Application of a RV park license shall follow the same procedure as any other new construction as follows: (a) The name and address of the applicant; (b) The location and legal description of the RV park; (c) A complete site plan showing location of streets, trailers, sites, sidewalks, sewer, gas and water lines and proposed installation, electrical service and disconnect location for each space; (d) Plans and specifications of all buildings and other improvements constructed or to be constructed within the RV park; (e) Such further information as may be requested by the City Engineer's office as boundary lines, survey, plot diagram drawn to engineer's scale, private sewer disposal system; (f) Upon approval of plans and specifications by City Engineer, City Building Official and City Health Office, license for above RV park will be issued by City Inspector's office; (g) Cost of license shall be issued on a pro rata basis so as to renew same as of January 15 of the following year. 11B -56 License Fee (a) Effective January 1, 1982, the annual license fee for each calendar year for each RV park shall be Twenty -five Dollars ($25.00), plus One Dollar ($1.00) for each lot or area in such RV park maintained for rental space for a Recreational Vehicle. (b) It shall be the duty of the owner or operator to: (1) provide for regular inspection of water and sanitary conveniences; (2) provide for the collection and removal of garbage and other waste materials; (3) report immediately to the City Police Department all acts of disorderly conduct committed by any person or persons inside the park; (4) register all guests.
