ORD 1981-25 - Wrecker AmendmentORDINANCE NO. 81 -25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 4A, AUTOMOBILE WRECKERS, TO INCREASE THE MAXIMUM FEE FOR POUND HAULS TO $25.00; PROVIDING PENALTIES FOR VIOLATION; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: Chapter 4A, Automobile Wreckers, of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the repeal of subsection 4A -14(d) as presently constituted and by the adoption of a new subsection 4A -14(d) that shall read as follows: Sec. 4A -14. Pound hauls and impounded vehicles. • (d) The maximum fee that may be charged by a permit holder for a pound haul shall be Twenty -five Dollars ($25.00) unless a winch, a dolly, or other special equipment is needed. Section 2: A person, firm or corporation commits an offense if he charges a fee in excess of that authorized by this ordinance, and anyone who shall fail to comply with same shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such re- peal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regula- ting and governing the subject matter covered by this ordinance. Section 4: If any provision or part of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their applica- tion to other persons or sets of circumstances and to the end all pro- visions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by City Council. The City Secretary is hereby directed to give notice hereof by causing the caption of the ordinance to be published in the official newspaper of the City of Huntsville at least twice within ten days after its passage.
