ORD 1983-30 - Building RegulationsORDINANCE NO. 83 -30 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 6, BUILDING AND BUILDING REGULATIONS, TO PROVIDE CERTAIN DEFINED EXCEPTIONS TO ARTICLE VI, SET BACK REQUIREMENTS; AND MAKING OTHER VARIOUS PROVISIONS RELATED THEREIO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: Section 1: Chapter 6, Buildings and Building Regulations, of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the adoption of a new section 6 -62, Permitted encroachments, which shall read: Sec. 6 -62 Permitted encroachments. The provisions of subsection 6-60(a) and 6 -60 (b) shall not apply to the following encroachments: (1) driveways, walks, steps for negotiating ground slopes, retaining walls, hedges,and natural growth, fences, paved patios and other paved structures used ornamentally or for gardening or for private recreation purposes; provided, however, no exception is provided by this subsection for any structure or feature, except a fence or retaining wall, that is higher than three feet (3') above ground level, and (2) uncovered porches, steps to building entrances, openwork fire balconies and fire escapes, chimneys and flues; provided, however, such structures or features are five feet (5') or more from any property line and at least ten feet (10') or more from any side street or front property line.
