ORDINANCE NO. 83 -4
AN ORDINANCE APPROVING CLAIM AND DELIVERY OF CERTIFICATE
OF OBLIGATION; AND CONTAINING OTHER PROVISIONS RELATED
HERETO.
WHEREAS the City Council of the City of Huntsville, Texas (City), by
Ordinance No. 82 -38, found that it was advisable for the City to purchase
a tractor with backhoe and front loader attachments; and that a Certifi-
cate of Obligation be issued by the City for all or any part of the cost
of same; and
WHEREAS the notice for said action was published at the times and in the
manner required by law; and
WHEREAS the City awarded a contract to Hyco Equipment Co., Inc. (Contractor),
Houston, Texas, in the amount of $57,785.00 as the lowest and best bid for
the purchase of a tractor with backhoe and front loader attachments; and
WHEREAS the City Council wishes to authorize payment thereof and delivery
of said Certificate of Obligation:
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, that:
Section 1: There is now due and owing to the Contractor the sum of
$57,785.00.
Section 2: The Certificate of Obligation herein authorized to be delivered
shall bear interest at the rate of 7.90 % per annum from date of
initial delivery shown on the face of such certificate.
Section 3: There shall be executed and delivered to said Contractor a
certificate of the City of Huntsville, Texas, Equipment Acquisition
Certificate of Obligation, dated November 16, 1982.
Section 4: The Mayor, City Secretary and other appropriate City officials
are hereby authorized and directed to deliver said Certificate and
to do any and all things necessary or convenient to carry out the
terms of this ordinance.
INTRODUCED, READ AND PASSED by the unanimous vote of the City Council of
the City of Huntsville, Texas, on this the 4th day of January, 1983.

CERTIFICATE FOR ORDINANCE

COUNTY OF WALKER §
We, the undersigned officers of the City Council of the
City of Huntsville, Texas, hereby certify as follows:
1. The City Council of the City of Huntsville, Texas,
convened in regular meeting on the 22nd day of February,
1983, at its regular meeting place in the City Hall within
said City, and the roll was called of the duly constituted
officers and members of said City Council and the City
Secretary, to -wit:

thus constituting a quorum. Whereupon, among other business,
the following was transacted at said meeting: a written
ORDINANCE DIRECTING THE GIVING OF NOTICE OF INTENTION
TO ISSUE CITY OF HUNTSVILLE, TEXAS, WATERWORKS AND
SANITARY SEWER SYSTEM REVENUE BONDS, SERIES 1983
was duly introduced for the consideration of said City
Council and read in full. It was then duly moved and
seconded that said ordinance be adopted; and, after due
discussion, said motion, carrying with it the adoption of
said ordinance, prevailed and carried by the following vote:
AYES: All members of said City Council shown present
above voted "Aye."
NOES: None.
The Mayor thereupon announced that the ordinance has
been duly and lawfully adopted.
2. That a true, full and correct copy of the aforesaid
ordinance adopted at the meeting described in the above and
foregoing paragraph is attached to and follows this Certifi-
cate; that said ordinance has been duly recorded in said City
Council's minutes of said meeting; that the above and foregoing
paragraph is a true, full and correct excerpt from said City
Council's minutes of said meeting pertaining to the adoption
of said ordinance; that the persons named in the above and
foregoing paragraph are the duly chosen, qualified and acting
officers and members of said City Council as indicated therein;
that each of the officers and members of said City Council
was duly and sufficiently notified officially and personally,
in advance, of the time, place and purpose of the aforesaid
meeting, and that said ordinance would be introduced and
considered for adoption at said meeting, and each of said
officers and members consented, in advance, to the holding of
said meeting for such purpose; that said meeting was open to
the public as required by law; and that public notice of the
hour, date, place and subject of said meeting was given as
required by Vernon's Texas Civil Statutes, Article 6252 -17,
as amended.
