ORD 1984-29 - Land AnnexationAN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY THAT LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF HUNTSVILLE, TEXAS: APPROVING A SERVICE PLAN FOR SAID AREA: AND MAKING VARIOUS OTHER FINDINGS AND PROVISIONS RELATED THERETO. WHEREAS, pursuant to Ordinance No. 84-22, the City of Huntsville ordered public hearings where all interested persons would be provided the opportunity to be heard on the proposed annexation of the property described in Exhibit "A" attached hereto; and WHEREAS notice of such public hearings was published in the Huntsville Item, a paper having general circulation in the City of Huntsville, Texas and Walker County, Texas, on Doth Sunday, September 23, 1984, and on Sunday, September 30, 1984, which dates were not more than 20 days nor less than 10 days prior to said hearings; and WHEREAS said public hearings were held at 7:00 p.m. on Tuesday, October 9, and at 8:00 p.m. on Tuesday, October 16, 1984, in the City Council Chambers of The City Council at City Hall, 1212 Avenue M, Huntsville, Texas, which dates are not more than forty /40\ days nor less than 2U days prior to the first consideration of this ordinance; and WHEREAS during said hearings the proposed service plan was made available for inspection and explained to the inhabitants of the areas to be annexed at that time; and WHEREAS the above described property lies within the extraterritorial jurisdiction of the City of Huntsville, Texas; and WHEREAS the above described property lies adjacent to and adjoins the City of Huntsville; NUW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: The following described land and territory lying adjacent to and adjoining the City of Huntsville, Texas, is hereby added and annexed to the City of Huntsville, Texas, and the said territory hereinafter described shall hereinafter be included within the boundary limits of the City of Huntsville, Texas and the present boundary limits of the City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include Said area within the corporate limits of the City of Huntsville, Texas, to-wit: HENDERSON LAND CO. KNOTTS APRIL POINT BEGINNING at the intersection of the north city limits with the west boundary of the Joe Ferro 50.6 -acre tract as described by deed recorded in Vol. 210, pg. 710, Walker County Deed Records; THENCE, with Ferro west boundary, in a northerly direction to Ferro's northwest corner, same being the southwest corner of the Frank Robinson, Sr. tract and in the east boundary of the TUC Wynne Unit; THENCE, with Ferro - Robinson common boundary in a easterly direction to the Ferro northeast corner, same being the northwest corner of Section One, Henderson Land Company Subdivision as shown by plat recorded in Vol. 1, Pg. 171, Walker County Plat Records, and continuiny with Henderson north boundary and Robinson south boundary 537.U8 ft to the southerly southeast corner of the Robinson tract and an "ell" corner of the Henderson tract; THENCE NU014'W988.24 ft to a corner in Parker Creek; THENCE, with meanders of the creek, same being common boundary of the Robinson and Henderson tracts: (1) N 39 057 E 28.27 ft; (2) N23°12'E 73.07 ft; (3) N26 °41'E 105.70 ft; (4) N19°35'E 116.92 ft; (5) N32 °06'E 128.28 ft; (6) N72 °48'E 132.67 ft; (7) N62 °34'E 36.65 ft; (8) N51 °40'E 91.98 ft; (9) N49 °52'E 65.48 ft; (10) N55 °57'E 80.68 ft; (11) S68 °40'E 77.36 ft; (12) S63 °08'E 108.01 ft; (13) S77 °33'E 79.06 ft; (14) S68 °18'E 86.93 ft; (15) N38 °37'E 65.66 ft; and (16) N82 °50'E 72.61 ft to the most northerly corner of the Henderson tract, same being the most westerly corner of the residual of the W.H. Knotts 49.33 -acre tract as described by deed recorded in Vol. 222, Pg. 357, Walker County Deed Records; THENCE, with the meanders of Parker Creek, same being the north boundary of the Knotts tract, in an easterly direction, approximately 1500 ft to the southwest corner of the Patrick M. Carmichael 8.860 -acre tract (April Point Mobile Home Park) as described by deed recorded in Vol. 374, Pg. 419, Walker County Deed Records; THENCE, with Carmichael west boundary: (1) NO1° 19' S7 "E (2) S88° 14' S5 "E (3) NO2° 02'09 "E (4) S88° 08'14 "E (5) S03° 00' 52 "W (6) S88313'01 "E (7) N01° 38'38 "E (8) S88 °08' 30 "E (9) N01° 34'28 "E Jenkins Road; 480.00 ft; 100.15 ft; 9.16 ft; 104.30 ft; 23.01 ft; 243.79 ft; 82.33 ft; 190.54 ft; and 150.15 ft to a corner on the south boundary of THENCE, with common boundary Carmichael tract and Jenkins Road, S88° 15'45 "E 209.00 ft to a corner in the west right -of -way for FM Highway 247; THENCE, with the west R.O.W. for FM 247 southerly to its intersection with City Limits as defined May 8, 1973; THENCE, with existing city limits, in a westerly direction to the POINT OF BEGINNING. Section 2: The Service Plan attached to this ordinance as Exhibit "B ", and made a part hereof for intents and purposes, is hereby adopted and approved as the service plan for the area annexed by this ordinance. Section 3: The above described territory and the area so annexed shall be a part of the City of Huntsville, Texas, and the property so added shall bear its pro rata part of the taxes levied by the City of Huntsville, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens of Huntsville and shall be bound by the acts, ordinances, resolutions and regulations of the City of Huntsville, Texas. Section 4: This ordinance shall take effect immediately upon its passage by City Council. PASSED AND APPROVED this day of November, 1984.
