AN ORDINANCE AUTHORIZING PUBLICATION OF NOTICE OF
INTENTION TO ISSUE CERTIFICATES OF OBLIGATION FOR
CONSTRUCTION OF PUBLIC WORKS; AND MAKING VARIOUS
PROVISIONS RELATED THERETO.
WHEREAS the City Council of the City of Huntsville, Texas, has heretofore
found and determined, and hereby affirmatively finds and determines,
that it is necessary and desirable for said City to construct public
works and purchase of land or rights -of -way for said City, including
the payment of contractual obligations for professional services in
connection therewith, to -wit: construction road and highway
improvements for said City, and that certificates of obligation be
issued by the City to pay all or any part of the cost of same; and
WHEREAS said City Council wishes to proceed with authorizing the
publication of notice of the City's intention to issue such
certificates of obligation;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:

1: The facts and recitations contained in the preamble of this
ordinance are hereby found and declared to be true and correct.
2: The City Secretary is hereby authorized and directed to cause
to be published Notice of Intention to Issue Certificates of
Obligation in substantially the following form:
NOTICE OF INTENTION
TO ISSUE CERTIFICATES OF OBLIGATION
NOTICE is hereby given that the City Council of the City of
Huntsville, Texas, at its meeting to be held on the day of
, 1985, commencing at 7:00 o'clock p.m. at the
City Council Chambers, 1212 Avenue M, Huntsville, Texas, 77340,
the City Council tentatively proposes to adopt an ordinance
authorizing the issuance of Certificates of Obligation, in
accordance with the terms and provisions of this notice,
constructing public works and purchase of land or rights -of -way
for said City, including the payment of contractual obligations
for professional services in connection therewith, to -wit:
constructing road and highway improvements for said City.
It is the intention of the City Council to pay all or any part of
the costs of such public works, and professional services related
thereto, for said City by the issuance of the City's Certificates
of Obligation, payable from ad valorem taxation in the maximum
amount of $100,000, bearing interest at a rate not in excess of
that prescribed by Article 712K-2, V.T.C.S., as amended, and
maturing over a period of years not to exceed twenty (20) years
from the date thereof, for the purpose of evidencing the
indebtedness of said City for all or any part of the cost of
such public works and professional services.

Section 3: The notice set forth in Section 2 shall be published in
accordance with Tex.Rev.Civ.Stat. art 2368a, once a week for
two (2) consecutive weeks in the Huntsville Item, a paper that
is of general circulation in the City of Huntsville and that
has been duly designated as the official newspaper of the City.
The date of first publication shall not be less than fourteen
(14) days prior to the date set in said notice for the receipt
of bids by Council. The notice shall be published in the
English and Spanish languages.
Section 4: For the reasons set forth in the notice of meeting posted as
the agenda on which this Ordinance was considered, a public
emergency and imperative necessity exist for this Ordinance to
be passed and take effect and be in full force and effect
immediately after its passage.
