ORD 1985-04 - Litter AwardORDINANCE NO. 85- 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AUTHORIZING LITTER REWARD; AND MAKING OTHER PROVISIONS AND FINDINGS RELATED THERETO. WHEREAS, under the provisions of Texas Revised Civil Statutes article 4477 -9a, section 2.01, a person commits an offense if that person disposes of trash, junk, garbage, refuse, unsightly matter, or other solid waste on public property (including street or right -of -way) or private property without the express written consent of the property owner; and WHEREAS such illegal dumping of trash damages property and creates a public health hazard; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: Section 1: Chapter 11, Health and Sanitation, of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the adoption of a new Section 11 -40, that shall read as follows: Section 11 -40. Litter Reward. There is hereby fixed and authorized payment of the cash amount of TWENTY FIVE DOLLARS AND NO CENTS ($25 00 ) for the arrest and conviction of any persons found guilty of committing the crime of Littering (Tex.Rev.Civ.Stat. art. 4477 -9a § 2.01) or unauthorized use of sanitation containers (Code § 11 -39), at any place within the corporate limits of the City; said reward, however, shall not apply to any officer or employee of the City, County, or State, who makes such arrest or report in the discharge of his official duties. Section 2: The City Manager is hereby authorized and directed to post placards and notices in City buildings, on City sanitation containers, or elsewhere to show that such reward has been offered as above described. Section 3: This reward is a standing offer, and shall be paid out of the Sanitation contingency fund of the City of Huntsville, Texas. Section 4: This ordinance shall take effect immediately upon its passage by the City Council of the City of Huntsville, Texas.
