ORD 1986-28 - Amend Development CodeV' • ORDINANCE NO. 86 -28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 30, THE DEVELOPMENT CODE, OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS; REDESIGNATING ESTATE LOTS AS RURAL RESIDENTIAL LOTS; MODIFYING STREET STANDARDS FOR RURAL RESIDENTIAL LOTS; MODIFYING STANDARD DESIGN FOR PAVED LOCAL STREETS; CHANGING SEWERAGE CONNECTION REQUIREMENTS FOR MULTIPLE DWELLING UNIT BUILDINGS; PERMITTING LIMITED RECHANNELING OF WATER COURSES; REPEALING ORDINANCES INCONSISTENT WITH THESE AMENDMENTS; PROVIDING A SAVINGS AND SEVERABILITY PROVISION; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. (4) Urban Residential developments with a density of two (2) dwelling units per acre or less may provide non- curbed and guttered paved streets as described in subsection 614.1. (5) For apartment lots with more than two (2) dwelling units, the minimum lot size is calculated according to the number of dwelling units as described in subsection 502.4. N/A Not Applicable Section 2: Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by amending Section 502.2 to read as follows: 502.2 Rural Residential Lots (Estate 6ets) In addition to the criteria listed in Table 5-1, the developer shall establish rural residential estate lots that conform to the following requirements: (1) Lots shall have a width of not less than one-half (1/2) nor more than two (2) times the depth. (2) The plat shall contain a statement limiting subdivision or splitting of the lots to a minimum size of six-tenth acre (0.6 acre) and one dwelling unit per lot ene aere. Section 3. Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the addition of a new section 604.4 that shall read as follows: 604.4 Location of Intersections (1) Arterial Streets The maximum distance between streets (centerline to centerline measurement) intersecting arterial streets shall be 1800 feet; the minimum distance shall be 800 feet. (2) Collector Streets The maximum distance between streets (centerline to centerline measurement) intersecting collector streets shall be 1000 feet; the minimum distance shall be 600 feet. (3) Local Streets The maximum distance between streets (centerline to centerline measurement) intersecting local streets shall be 1000 feet; the minimum distance shall be 250 feet. (4) Offset Streets Where it is necessary to create staggered or offset streets, the minimum distance shall be 125 feet (centerline to centerline measurement). Section 4. Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the amendment of Section 614.3 to read as follows: 614.3 Pavement Alternative for Low Density, Rural Subdivisions Residential subdivisions located in the extra-territorial jurisdiction (ETJ) of the City . may provide streets constructed according to the low density residential street standards contained in Figure 6-7 if the minimum lot size is restricted by the plat and individual deeds to a minimum lot size of acre per dwelling unit. Section 6. Chapter 30 o the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the amendment of Table 6-4 to read as follows: TABLE 6-4 STREET DESIGN BY EQUIVALENT AXLE LOADS (20 YEAR DESIGN LIFE) STREET DESCRIPTION AXLE LOADS EQUIVALENT TO 18,000 LBS. Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the amendment of Section 615.2 to read as follows: 615.2 Standard Structural Section Design for Paved Local Streets In lieu of a designed street structural section, the developer may design and construct local street pavement sections (see also section 615.1) as follows: (1) 2" hot mix asphaltic concrete ( H.M.A.C.), 6" flexible base, 6" stabilized subgrade; (2) 5" H.M.A.C., 6" stabilized subgrade where necessary (see section 615.3); (3) 6" reinforced Portland Cement concrete with 2" sand cushion permitted), 6" stabilized subgrade where necessary (see section 615.3). Section 8. Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the addition of a new paragraph (7) to Section 615.4. Other Basic Criteria, and that paragraph (7) shall read as follows: (7) Any other design methods not specifically mentioned in this code may be used, with prior approval of the City. Section 9. Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the repeal of Section 903.1 as presently constituted, and by the adoption of a new Section 903.1 that shall read as follows: 903.1 Duplex and Multi - family Dwelling Units The developer shall install individual sanitary sewer service connections for each dwelling unit in duplex or two - family buildings. Buildings containing more than two dwelling units may_ provide a common sewerage collection system for each building. Section 10. Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the repeal of Section 1001.9 as presently constituted, and by the adoption of a new Section 1001.9 that shall read as follows: 1001.9 Line of Flow The developer shall allow water courses to follow their natural lines of flow; provided, however, that rechanneling or rerouting of water courses may be allowed where approved by the City and where the point at which the water course enters the lots and the point at which it leaves the dot are not changed. • Section 11. This ordinance shall not be construed or held to repeal a former ordinance, whether such former ordinance is expressly repealed or not, as to any offense committed against such former ordinance or as to any act done, any penalty, forfeiture, or punishment so incurred, or any right accrued or claim arising under the former ordinance, or in any way whatever to affect any such offense or act so committed or so done, or any penalty, forfeiture or punishment so incurred or any right accrued or claim arising before this act takes effect, save only that the proceedings thereafter shall conform to the ordinance in force at the time of the proceedings, so far as practicable. This section extends to all repeals, either by express words or implication. Nothing in this section, or any section of this ordinance, shall be construed as abating any action now pending under or by virtue of any ordinance of the City herein repealed; or as discontinuing, abating, modifying, or altering any penalty accrued or to accrue, or as affecting the liability of any person, firm or corporation, or as waiving any right of the City under any ordinance in force at the time of passage of this ordinance. Section 12. Where there exists a conflict between any of the regulations or limitations prescribed by this ordinance and any other regulations applicable to City development, whether the conflict be with respect to zoning, building regulations, subdivision regulations or any other matter, the more stringent limitation or requirement shall govern and prevail. Section 13. Each section and each provision or requirement of any section of this ordinance shall be considered separable, and the invalidity of any portion of this ordinance shall not affect the validity or the enforceability of any other portion. Section 14. Any person, firm, or corporation violating any provision of this Ordinance or failing to comply with any requirement of this Ordinance will be guilty of a misdemeanor and subject to a fine of up to Two Hundred Dollars ($200.00) upon conviction. Each day during or upon which said person shall violate or continue violation of any provision of this Ordinance or non-compliance with any requirement of this Ordinance shall constitute a distinct and separate offense. The violation of any provision of this Ordinance or the failure to comply with any requirement of this Ordinance shall each constitute a distinct and separate offense. Section 15. The City Secretary is hereby directed to cause the caption of this Ordinance to be published at least twice within ten days of final passage.
