ORD 1986-20 - ElectricalORDINANCE NO. 86- 20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING ITS CODE OF ORDINANCES TO ADOPT THE 1984 EDITION OF THE NATIONAL ELECTRIC CODE; PROVIDING A PENALTY OF UP TO $200 PER DAY FOR EACH VIOLATION; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THE ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: Section 1: Chapter 7, Electricity, of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the repeal of Sec. 7-6(a) as presently constituted, and by the adoption of a new Sec. 7-6(a) that shall read as follows: Sec. 7-6. Installation standards. (a) In every case where no specific type or class of material, or no specific standard of construction is prescribed by the statutes of the State of Texas, installation shall be made in conformity to the standards provided by the National Electrical Code, 1981 1984 Edition (a copy of which is authenticated by the signatures of the mayor and the city secretary, and made a public record by this section, is on file in the city secretary's office). Section 2: Chapter 7, Electricity, of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the repeal of Sec. 7-7(f), and by the adoption of a new Sec. 7-7(f) that shall read as follows: Sec. 7-7(f). Every new service except single-family residential service, installed within the City, shall have a service disconnecting means installed on the exterior of the building. Section 3: Any person, firm, or corporation who shall violate any of the provisions of Chapter 7, Electricity, as amended, or who shall fail to comply with the same, shall be guilty of a class C misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding two hundred dollars ($200.00). Each day during or upon which said person shall violate or continue violation of any provision of this Ordinance or non-compliance with any requirement of this Ordinance shall constitute a distinct and separate offense. The violation of any provision of this Ordinance or the failure to comply with any requirement of this Ordinance shall each constitute a distinct and separate offense. Section 4: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this Ordinance. Section 5: All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other Ordinances regulating and governing the subject matter covered by this Ordinance. Section 6: The City Secretary is hereby directed to cause the caption of this Ordinance to be published at least twice within ten days of final passage. This ordinance shall take effect ten (10) days after the date of final passage.
