ORD 1987-30 - Downtown Fire District 09-22-1987ORDINANCE NO. 87-30
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, ALTERING THE BOUNDARIES OF THE
DOWNTOWN DISTRICT (FIRE DISTRICT); AND MAKING OTHER
PROVISIONS RELATED THERETO.
WHEREAS the Fire District of a city normally encompasses two or more
contiguous blocks devoted to hotels, motels, office buildings,
greenhouses, service stations, banks, bowling alleys, theatres, night
clubs, restaurants, freight depots, warehouses, museums, and churches,
which cover more than 50% of the land area (excluding streets); and
WHEREAS the Downtown District which serves as the fire district of the City
appears to be overbroad;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
Section 1: Chapter 6, Buildings and Building Regulations, of the Code of
Ordinances of the City of Huntsville, Texas, is hereby amended by the
repeal of Subsection 6-2(A)(16) as presently constituted, and by the
adoption of a new Subsection 6-2(A)(16) that shall read as follows:
(16) Section 301.2 is amended to read:
301.2--Scope.
301.2.1. For the purpose of this code, the fire district is
established as follows:
Beginning at the intersection of the east line of Avenue M and
south line of 10th Street;
Thence easterly along said south line of 10th Street to the west
line of Avenue J;
Thence southerly along said west line of Avenue J to the north line
of 13th Street;
Thence westerly along said north line of 13th Street to the east
line of Avenue M;
Thence northerly along east line of Avenue M to the point of
beginning.

Section 2: Chapter 30, Community Development, of the Code of Ordinances of
the City of Huntsville, Texas, is hereby amended by the repeal of
§ 103.1(1) Downtown District (Fire District) of the Development Code as
it presently exists, and by the adoption of a new § 103.1(1) that shall
read as follows:
103.1 Description of Districts
(1) Downtown District (Fire District)
This district, also called the Fire District is intended as
an area of high intensity use on which a full range of
public facilities are found. The standards and high
densities prescribed for the district are designed to
optimize utilization of in-place facilities.
Beginning at the intersection of the east line of Avenue M
and south line of 10th Street;
Thence easterly along said south line of 10th Street to the
west line of Avenue J;
Thence southerly along said west line of Avenue J to the
north line of 13th Street;
Thence westerly along said north line of 13th Street to the
east line of Avenue M;
Thence northerly along east line of Avenue M to the point of
beginning.
Section 3: If any section, subsection, sentence, clause, phrase or portion of
this Ordinance is for any reason held invalid or unconstitutional, such
portion shall be deemed a separate, distinct and independent provision
and such holding shall not affect any of the remaining provisions of
this Ordinance.
Section 4: All Ordinances and parts of Ordinances in conflict with the
provisions of this Ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency and
in all other respects this ordinance shall be cumulative of other
Ordinances regulating and governing the subject matter covered by this
Ordinance.
Section 5: This ordinance shall take immediately from and after its passage
by City Council.
