AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, REQUIRING DETAILED
TRENCH CONSTRUCTION PLANS; AMENDING THE BUILDING CODE REGARDING
TRENCH CONSTRUCTION; AND MAKING OTHER FINDINGS AND PROVISIONS
RELATED THERETO.
WHEREAS the Texas Legislature has required municipalities to include detailed
trench construction plans in bid documents, contracts and building
codes;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
Section 1: That Chapter 6, Buildings and Building Regulations, of the Code of
Ordinances of the city of Huntsville, Texas, is hereby amended by
the adoption of a new Article III. that shall read as follows:
ARTICLE III. Trench Construction
Sec. 6 -30. City Contracts.
The City Manager and City Engineer are hereby directed to
include in bid documents and the contract of construction projects
in which trench excavation will exceed a depth of five feet
detailed plans and specifications for trench systems that meet
Occupational Safety and Health Administration standards. The plans
and specifications shall include a pay item for these same safety
systems.
Sec. 6 -31. No person shall enter into a contract for a
construction project in the City or its extraterritorial
jurisdiction in which trench excavation will exceed a depth of five
feet unless the bid documents and the contract include detailed
plans and specifications for trench safety systems that meet
Occupational Safety and Health Administration standards and these
plans and specifications include a pay item for these same safety
systems.
Sec. 6 -32. A person commits an offense if he works in a trench
excavation which exceeds a depth of five feet unless the trench is
protected by a trench safety system that meets Occupational Safety
and Health Administration standards.
Section 2: The City Secretary is hereby directed to cause the caption of this
Ordinance to be published at least twice within ten days of final
passage. This ordinance shall take effect ten (10) days after the
date of final passage.
