ORD 1987-21 -Bicycles, Regulating Use of , Bike Lane, Bike Routes 09-08-1987ORDINANCE NO. 87 -21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 12, MOTOR VEHICLES AND TRAFFIC, BY ADOPTING A NEW SECTION 12 -23. BICYCLES; REGULATING USE OF BICYCLES; ESTABLISHING BIKE LANES, ESTABLISHING BIKE ROUTES; PROVIDING A PENALTY OF $1 -200 FOR CERTAIN OFFENSES; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Section 1: Chapter 12, Motor Vehicles and Traffic, of the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the adoption of a new Section 12 -23 that shall read as follows: Sec. 12 -23. Bicycles (a) Bicycle lane. A portion of a roadway or a shoulder that has been designated by the City for use by bicyclists. It is distinguished from the portion of the roadway for motor vehicle traffic by a paint stripe, a curb or other device. Bicycle route. A system of roads, streets, paths or ways designated by the City and identified by appropriate markers as being open to bicycle travel, regardless of whether such facilities are designated for the exclusive use of bicycles or are to be shared with other transportation modes. (b) Bicycle lanes - use. (1) A person commits an offense if he operates any vehicle other than a bicycle along or within a bicycle lane except in an emergency when disabled, or when necessary to make a permissible turn, enter or leave a parking space, or pick up or discharge passengers or goods. (2) A person commits an offense if he operates a bicycle outside a bike lane on a roadway containing a designated bike lane except in an emergency, at intersections, or where necessary to make a permissible turn, leave or cross the roadway, or to maintain the safe operation of the bike. Section 2: The following described streets are designated as bike routes: Street Name Limits Avenue J 20th Street to Sam Houston Avenue Lake Road All Section 3: Article VIII. Schedules of Designated Streets and Zones referred to in this Chapter is hereby amended by the addition of Schedules XIV. Bike Lanes, and XV. Bike Routes, and said schedules shall be revised to reflect the streets designated by this Ordinance. Section 4: The City Manager is hereby authorized and directed to cause the posting of proper signs along the above described streets. Section 5: It shall be unlawful for a driver of a vehicle or operator of a bicycle to disobey the instructions of the signs placed in accordance with the provisions of this Ordinance, unless at the time otherwise directed by a police officer. Section 6: Any person, firm, or corporation violating any provisions of this Ordinance or failing to comply with any requirement of this Ordinance will be guilty of a misdemeanor and subject to a fine of up to Two Hundred Dollars ($200.00) upon conviction. Each day during or upon which said person shall violate or continue violation of any provision of this Ordinance or non-compliance with any requirement of this Ordinance shall constitute a distinct and separate offense. The violation of any provision of this Ordinance or the failure to comply with any requirement of this Ordinance shall each constitute a distinct and separate offense. Section 7: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this Ordinance. Section 8: All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other Ordinances regulating and governing the subject matter covered by this Ordinance. Section 9: The City Secretary is hereby directed to cause the caption of this Ordinance to be published at least twice within ten days of final passage.
