AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, DETERMINING THAT A PROCUREMENT IS
NECESSARY BECAUSE OF UNFORESEEN DAMAGE TO PUBLIC
PROPERTY (THE SPRING LAKE WATER TANK); AUTHORIZING
NECESSARY CHANGE ORDER IN A CONTRACT FOR PAINTING AND
REPAIR OF THE SPRING LAKE WATER TANK TO REPAIR SUCH
DAMAGE; AUTHORIZING OTHER CHANGES TO THE CONTRACT AND
MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO.
WHEREAS the City of Huntsville has previously awarded a contract for painting
and repair to Water Tank Service Co. in the amount of $51,800.00; and
WHEREAS the City of Huntsville desires to enter into change orders for
$46,499.50; and
WHEREAS, after drainage and further inspection of the tank, unforeseen damage
to the public property was discovered in that the sheet metal roof was rusted
out;
NOW, THEREFORE,
Be it ordained by the City Council of the City of Huntsville, Texas, that:
Section 1: The City Council authorizes the City Manager and City Engineer to
execute change orders totaling $6,892.00 to its contract with
Water Tank Service Co. for changes in plans and specifications not
related to unforeseen damage to public property.
Section 2: The City Council hereby determines and find that a procurement is
necessary because, or that this is a case, of unforeseen damage to
public property.
Section 3: The City Council authorizes its City Manager and City Engineer to
execute change orders totaling $39,607.50 to its contract with
Water Tank Service Co. for procurements, construction of public
works, and /or the purchase of materials, equipment, supplies
and /or machinery because of unforeseen damage to public property.
Section 4: The City Council finds and determines that the change orders
authorized in Section 3 are not subject to the notice and bid
provisions of Texas Local Government Code Chapters 252 and 271.
Section 5: This ordinance shall take effect immediately upon passage by City
Council.
