ORD 1990-03 - Zoning Appoints A Commission For Zoning 02-27-1990ORDINANCE NO. 90 -3
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, APPOINTING A ZONING COMMISSION;
AND MAKING OTHER PROVISIONS AND FINDINGS RELATED
THERETO.
WHEREAS State law, Texas Local Government Code Chapter 211, prescribes
the method for Texas cities to implement certain land use
regulations;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT:
Section 1: The municipal planning commission of the City of Huntsville,
Texas, is appointed as the commission to serve as the zoning
commission. Texas Local Government Code Section 211.007(a).
Section 2: The zoning commission shall recommend boundaries for the
original zoning districts and appropriate zoning regulations
for each district. Id.
Section 3: The zoning commission shall make a preliminary report and hold
public hearings on that report before submitting a final report
to the City Council. Id. Section 211.007(b).
Section 4: A public hearing by the City Council shall be held, after the
notice required by Section 211.006(a) of the Texas Local
Government Code, jointly with a public hearing required to be
held by the zoning commission. Id.
Section 5: The planning commission, acting as the zoning commission, shall
have all the rights, powers, duties and responsibilities of a
zoning commission as set forth in Chapter 211 of the Texas
Local Government Code, and shall conduct such public hearings
as necessary or desirable to accomplish its duties.
Section 6: This ordinance shall take effect immediately upon its approval
by City Council. //
