ORD 1995-25 - Amend Development Code (Ch. 30) 08-15-1995ORDINANCE NO. 95-25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 30, THE DEVELOPMENT CODE; REGULATING LAND USE, STRUCTURES, BUSINESSES, AND RELATED ACTIVITIES; REGULATING SUBDIVISIONS AND PROPERTY DEVELOPMENT; REGULATING SIGNS; PROVIDING A CRIMINAL PENALTY UP TO $2,000 A DAY FOR CERTAIN VIOLATIONS; PROVIDING FOR CIVIL PENALTIES; ADOPTING SAVINGS AND REPEALING PROVISIONS; PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF; AND MAKING OTHER FINDINGS AND RELATED PROVISIONS. WHEREAS the City's Planning and Zoning Commission has reviewed the City's Development Code and has made many recommendations regarding amendments to the Code; and WHEREAS the City Council and the City Planning and Zoning Commission have held public hearings on these recommendations; and WHEREAS the City Council adopts the amendments to the Development Code to lessen congestion in the streets; to secure safety from fire, panic and other dangers; to promote health and the general welfare; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewers, schools, parks, and other public requirements; and WHEREAS the City Council finds that these rules governing the plats and subdivisions of land within the City's jurisdiction will promote the health, safety, morals or general welfare of the City and the safe, orderly, and healthful development of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: Chapter 30 of the Code of Ordinances of the City of Huntsville, Texas, which chapter is known as the Development Code, is now amended and replaced by the new Chapter 30 (Exhibit A). SECTION 2: Any person, firm or corporation violating any provision of this Code, or failing to comply with any requirement of the Code, will be guilty of a misdemeanor and subject to a fine of up to two thousand ($2,000.00) upon conviction. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional, then that portion shall be deemed a separate, distinct and independent provision. The invalidity of any such portion of this ordinance shall not invalidate other sections or provisions of this ordinance and all provisions of this ordinance are declared to be severable. SECTION 4: All ordinances and parts of ordinances in conflict with the provisions of this ordinance are repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. SECTION 5: This ordinance shall take effect ten (10) days after its passage by the City Council. The City Secretary shall publish the caption of this ordinance in the official City newspaper at least twice with ten (10) days of its passage. PASSED AND APPROVED THIS 15TH DAY OF AUGUST, 1995.
