ORD 1997-05 - Amend Personnel Rules - Cobra 02-04-1997ORDINANCE 97 -05 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 8, COMPENSATION, OF THE PERSONNEL RULES OF THE CITY OF HUNTSVILLE, TEXAS, TO MAKE COBRA CHANGES; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: SECTION 1. Chapter 8, "COMPENSATION," of the City of Huntsville's Personnel Rules, is amended by adopting an amended Section 7, Health and Accident Benefits; COBRA; Retirement, that shall read: Section 7. Health and Accident Bene its: COBRA: Retirement. a. Full -time regular employees will receive accident and health benefits as prescribed in the applicable programs. Part -time employees will not participate in such programs. b. Dependents covered by the City's medical plan are entitled to continue medical coverage for up to 36 months if they are. 1. the surviving spouse and /or children of a deceased employee; 2. a separated or divorced spouse and /or children of a covered employee; or 3. losing coverage because of age. C. 1. Employees and /or their dependents covered by the City's medical plan are entitled to continue medical coverage for up to 18 months if the employee's medical benefits would otherwise end because of a) reduction of hours worked or a layoff, b) resignation; or c) termination due to conduct other than gross misconduct. 2. Employees and /or their dependents covered by the City's medical plan who are eligible for 18 months COBRA coverage are entitled to continue medical coverage for an additional 11 months if City determines that the employee /and or their dependents are disabled under the Social Security Act at any time during the first 60 days of COBRA coverage. d. Individuals eligible for any continuation of coverage under this section must elect to continue coverage within 60 days of the event otherwise ending coverage. The individual must pay for the coverage monthly. e. A child born to or placed for adoption with the covered employee during a period of COBRA coverage will be eligible for coverage with proper notification. f. Effective June 30, 1997, an individual's right to continue coverage under this section ends when the individual becomes covered by another employer's group health plan that does not limit or exclude coverage for preexisting conditions. g. The City may cancel coverage before the applicable 18 or 36 -month extension i, f 1. the City cancels its health plan for all employees; 2. the person fails to pay the monthly premium; or 3. the person becomes covered by another health plan or Medicare. See 42 U.S.0 § 300 bb -1; Personnel Rules chapter 12, § 4. SECTION 2. This ordinance shall take effect from and after its adoption by City Council. APPROVED this 4th day of February, 1997.
