ORDINANCE 98 -14
AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION AND
DELIVERY OF CONTRACT BETWEEN THE CITY OF HUNTSVILLE AND
THE CITIES OF BRYAN AND COLLEGE STATION ENTITLED "DISPOSAL
SERVICES AGREEMENT "; CONTAINING OTHER PROVISIONS RELATING
TO SUCH SUBJECT; AND PROVIDING THAT THIS ORDINANCE SHALL
TAKE EFFECT FROM AND AFTER ITS FINAL PASSAGE
WHEREAS the City Council of the City of Huntsville (the "City Council ") desires to approve the
execution and delivery of a contract (the "Contract ") between the City of Huntsville
(the "City ") and the Cities of Bryan and College Station; and
WHEREAS the City Council is authorized to enter into the Contract pursuant to the City Charter
of the City and pursuant to general laws of the State of Texas; and
WHEREAS the Council has reviewed the Contract and has determined that it is in the best
interests of the City to enter into the Contract;
Now, Therefore, Be it Ordained by the City Council of the City of Huntsville, Texas, that:
Section 1: The City is hereby authorized to enter into a contract with the Cities of Bryan and
College Station in substantially the form attached hereto, which is hereby approved
as to the form and substance, subject to such insertions, completions and variations
as shall be approved by the officers of the City (such approval to be evidenced by
execution of the Contract and by approval of the City Attorney who shall pass upon
the Contract as executed), and the Mayor or any other duly appointed person is
hereby authorized and directed to execute and deliver the Contract and the City
Secretary is hereby authorized and directed to attest thereto and impress the seal of
the City thereupon.
Section 2: The Council hereby affirmatively finds, determines and declares that all matters set
forth in the preamble of this Ordinance are true, correct and complete.
Section 3: It is hereby found, determined and declared that a sufficient written notice of the
date, hour, place and subject of this regular meeting of the Council was posted at a
place convenient to the meeting at the City Hall for the time required by law
preceding this meeting and that such place of posting was readily accessible at all
times to the general public from the time of posting to the time of this meeting; that
the foregoing was done as required by the Open Meetings Law, as amended; and that
this meeting has been open to the public as required by law at all times during which
this Ordinance and the subject matter thereof has been discussed considered and
formally acted upon.
Section 4: This Ordinance shall be and become effective from and after its adoption upon its
passage.
