ORD 1998-07 - Amend Personnel Rules - Nepotism 02-24-1998ORDINANCE 98 -07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 4, APPOINTMENTS, TRANSFERS, PROMOTIONS, OF THE PERSONNEL RULES OF THE CITY OF HUNTSVILLE, TEXAS, TO AMEND THE NEPOTISM RULES; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: SECTION 1. Chapter 4, "APPOINTMENTS, TRANSFERS, PROMOTIONS," of the City of Huntsville's Personnel Rules, is amended by adopting an amended Section 4, Nepotism, Fraternization, and Romantic Relationships between Employees, that shall read: Section 4. Nepotism. Fraternization, and Romantic Relationships between Employees. a. No employee may directly or indirectly appoint to City service, supervise, or be supervised by a member of his or her immediate family. Immediate family means a person related in the second degree by affinity (marriage) or in third degree by consanguinity (blood). The City Manager and the directors may not appoint any person to a division that the person has a relative within the second degree by affinity or within the third degree by consanguinity. b. The City Manager may apply the nepotism prohibition in other organizational and /or personal relationships when failure to do so would be detrimental to the City. C. The City Manager may not appoint any person related in the second degree by affinity or in the third degree by consanguinity to the City Manager, to any office, position, clerkship or other service of the City, except where authorized by Texas law. For example, the rule prohibits an employee from supervising the employee's spouse's first cousin, but not the spouse of the employee's first cousin.
