AN ORDINANCE AMENDING SECTION 20.10.01 "JUNKED VEHICLE - DEFINED" TO
DEFINE JUNKED VEHICLE IN ACCORDANCE WITH THE DEFINITION CONTAINED
IN THE TEXAS TRANSPORTATION CODE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the 76" Legislature passed H.B. 1103 redefining "junked vehicle" under State
law; and
WHEREAS, the definition contained in Section 20.10.01 of the Code of Ordinances is not
consistent with State law, as amended, and needs to be amended; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
that:
SECTION 1: Title 20 "Motor Vehicles and Traffic," Part 20.10 "Abatement and Removal
of Junked Vehicles," Section 20. 10.01 "Junked Vehicle- Defined" is hereby amended to hereinafter
read as follows:
20.10.01 Junked vehicle— Defined.
The definition of "junked vehicle" found in Section 683.071, Texas Transportation Code, as
amended from time to time, shall apply to this Part.
SECTION 2: This Ordinance shall become effective from and after the date of its passage.

1 -2 relating to when a vehicle becomes a junked vehicle.
-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
_ -4 SECTION 1. Section 683.071, Transportation Code, is amended
1 -5 to read as follows:
1 -6 Sec. 683.071. DEFINITION. In this subchapter, "junked
1 -7 vehicle" means a vehicle that is self - propelled [ .. 1_3
1 -8 and:
1-9 (1) does not have lawfully attached to it:
1 -10 (A) an unexpired license plate; or
1 -11 (B) a valid motor vehicle inspection
1 -12 certificate;
: -13 (2) is wrecked, dismantled or partially dismantled, or
1 -14 discarded; or
1 -15 (3) is inoperable and has remained inoperable for more
_ 16 than:
1 -17 (A) 72 consecutive hours if the vehicle is on
: -18 public property; or
1 -19 (B) 30 [443 consecutive days, if the vehicle is
1 -20 on private property.
-21 SECTION 2. This Act takes effect September 1, 1999.
1 -22 SECTION 3. The importance of this legislation and the
1 -23 crowded condition of the calendars in both houses create an
1 -24 emergency and an imperative public necessity that the
2 -1 constitutional rule requiring bills to be read on three several
2 -2 days in each house be suspended, and this rule is hereby suspended.
