ORD 1999-08 - Beautification Advisory Committee 02-23-1999ORDINANCE NO. 99-08 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, CREATING THE HUNTSVILLE BEAUTIFICATION ADVISORY COMMITTEE TO RECOMMEND PROGRAMS TO KEEP THE CITY BEAUTIFUL AND TO ATTEMPT TO CLEAN -UP AND FIX -UP THE CITY AND ITS AREAS; SETTING THE NUMBER OF MEMBERS OF THE COMMITTEE AND THE MAKEUP OF THE COMMITTEE; SETTING UP MEETINGS AND PROVIDING FOR A QUORUM; DEFINING THE DUTIES OF THE COMMITTEE; MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: There is hereby created the Huntsville Beautification Advisory Committee, which shall be governed by the following rules and regulations: a) Creation; number of members. The committee provided for herein shall be comprised of six members to be recommended by the Mayor and approved by City Council. The name of the committee may be changed or amended by resolution of the City Council. b) Terms staggered. Three of the members of the committee originally appointed shall be for a term of one (1) year, and three of the members of the committee originally appointed shall be for a term of two (2) years. Thereafter, the term of each committee member shall be two (2) years. C) Meetings. Four members of the committee shall constitute a quorum for the conduct of business. The members of the committee shall regularly attend meetings and public hearings of the committee and shall serve without compensation except for reimbursement of authorized expenses attendant to the performance of their duties. The Mayor shall designate the chairman and the vice - chairman from among its members. The committee shall meet regularly and shall designate the time and place of its meetings. Meetings shall be held in accordance with the Open Meetings Act. The committee shall adopt its own rules of procedure and keep a record of its proceedings. Newly appointed members shall be installed at the first regular meeting after their appointment. d) Duties of committee. The committee shall have the following responsibilities: Propose city wide clean city and environmental program plans including: • Interstate corridor landscaping from Park Road 40 to FM 1696 • Beautification of arterial streets and other significant sites • Community pride advocacy • Neighborhood beautification /clean -up • Business beautification /clean -up • Citywide clean -up, paint -up, fix -up 2. Evaluate City actions in light of these programs. 3. Determine and recommend to the City Council beautification program priorities on a Citywide basis; 4. Carry out such other tasks as the City Council may designate; and 5. Seek government and private sector grants. e) Sub - committees. To accomplish these responsibilities, the committee may establish sub- committees. Each sub - committee shall be chaired by a committee member with an unspecified number of community volunteers chosen by the committee as working sub - committee members. Section 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such shall be deemed a separate, distinct and independent provisions, and such holding shall not affect the validity of the remaining portions thereof. Section 3: This ordinance shall be in full force and effect from and after its passage and approval. Passed and approved this 231 day of February, 1999. THE CITY OF HUNTSVILLE William B.
