ORD 2000-25 - Parking - County Judges 10-10-2000AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING SECTION
20.06.03 "PROHIBITED CURB ZONE PARKING," SUBSECTION B.1. OF THE CODE OF
ORDINANCES BY ADDING FEDERAL, STATE AND COUNTY JUDGES TO THE LIST
OF THOSE PERSONS ENTITLED TO AN AFFIRMATIVE DEFENSE TO
PROSECUTION; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
that:
SECTION 1: Section 20.06.03 "Prohibited Curb Zone Parking," Subsection B.1. is hereby
amended by adding a new Sub - subsection j. which shall hereinafter read as follows:
B. It is an affirmative defense to any prosecution under subsection (a) (1) and (2)
of this section if:
Such vehicle was owned by, driven by or in possession of the following designated
individuals who are performing county, state or governmental business:
j. All federal, state, and county judges (exempt tags or judge tags).
SECTION2: If any portion of this Ordinance shall, for any reason, be declared invalid by any
court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and
the City Council determines that it would have adopted this Ordinance without the invalid provision.
SECTION 3: This Ordinance shall take effective immediately from and after the date of its
passage.
