ORD 2001-32 - Wild and Exotic Animals 12-11-2001ORDINANCE NO. 2001-32 AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING SECTION 6.01.08 OF THE CITY CODE TO INCLUDE ADDITIONAL WILD AND EXOTIC ANIMALS TO THE LIST OF ANIMALS; PROVIDING FOR A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Texas State Legislature passed House Bill 1362 which amended the Texas Health and Safety Code and listed those animals that are classified as "dangerous wild animals;" and WHEREAS, Section 6.01.08 prohibits a person from intentionally or knowingly keeping a wild animal inside the City limits and Section 6.01.08 B. lists such animals; and WHEREAS, the City desires to have the list contained in Section 6.01.08 B. of the City Code to be consistent with the definition of dangerous wild animals contained in the Texas Health and Safety Code; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: Title 6 "Animals and Fowl," Section 6.01.08 "Wild and Exotic Animals" is hereby amended by amending Subsection B. to add the animals listed as follows: 6.01.08 Wild and exotic animals. B. A person commits an offense if he /she intentionally or knowingly keeps, maintains or has in his possession or under his/her control, within the city, any of the following animals: 24. Ocelot. 25. Bobcat. 26. Serval. 27. Caracal. 28. Jackal. 29. Any hybrid of any animal listed. SECTION 2: If any portion of this Ordinance shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the City Council determines that it would have adopted this Ordinance without the invalid provision.
