AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, REZONING A PORTION OF
THE BADGER SUBDIVISION FROM A MANAGEMENT ( "M ") DISTRICT TO A
NEIGHBORHOOD CONSERVATION ( "NC ") DISTRICT; PROVIDING FOR A
SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, residents of a portion of the Badger Subdivision in the City of Huntsville,
Walker County, Texas, presented a petition to the City to rezone a portion of the subdivision from
a Management ( "M ") zoning district to a Neighborhood Conservation ( "NC ") zoning district; and
WHEREAS, the City gave proper public notice and held public hearings, both before the
Planning and Zoning Commission and the City Council, all in accordance with law; and
WHEREAS, the Planning and Zoning Commission considered the request and has
recommended to the City Council that a portion of the Badger Subdivision be rezoned from the
Management ( "M ") District to the Neighborhood Conservation ( "NC ") District; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
that:
SECTION 1: The portion of Badger Subdivision to the City of Huntsville, Texas, shown on
Exhibit "A" attached hereto and incorporated herein is hereby rezoned from the Management "M"
Zoning District to the Neighborhood Conservation "NC" Zoning District.
SECTION 2: If any portion of this Ordinance shall, for any reason, be declared invalid by any
court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and
the City Council determines that it would have adopted this Ordinance without the invalid provision.
SECTION 3: This Ordinance shall take effective immediately from and after the date of its
passage.
