ORD 2001-18 - M. Johnson Survey Street Right Of Way 08-21-2001ORDINANCE NO. 2001-18 AN ORDINANCE ABANDONING STREET RIGHT -OF -WAY IN THE M. JOHNSON SURVEY, ABSTRACT NO. 299 WITHIN THE J. R. MURRAY ESTATE ADDITION TO THE CITY OF HUNTSVILLE, TEXAS, AND CONVEYING THE SAME BY QUIT CLAIM DEED TO JOHN AMICK, JR.; AND DECLARING AN EFFECTIVE DATE. WHEREAS, an approximate 26.9 acre tract of land situated in Walker County, Texas, lying partly in the P. Gray League, Abstract No. 24, and partly in the M. Johnson Survey, Abstract No. 299 was subdivided and recorded in Volume 36, Page 124 of the Deed Records of Walker County, Texas; and WHEREAS, the subdivision was named the "J. R. Murray Estate Addition to the City of Huntsville, Texas;" and WHEREAS, the subdivision shows a fifty foot (50') wide right-of-way for a public street between Lots 6 and 7; and WHEREAS, the right-of-way has never been used by the City for a public street and the City has no desire to construct a street in said right-of-way; and WHEREAS, the property adjacent to said right-of-way is now owned by Cornerstone Apartments on the south and John Amick, Jr. on the north; and WHEREAS, state law authorizes the City to abandon the right-of-way and sell it to adjoining landowners and Cornerstone Apartments does not desire to purchase its respective one-half (1/2) interest in the right-of-way, but John Amick, Jr. desires to purchase all the street right-of-way from the City; and WHEREAS, the City has had the property appraised and the fair market value of the right-of- way is $1,677.00; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: The fifty foot (50') wide street right-of-way as shown on the subdivision plat for the J. R. Murray Estate Addition to the City of Huntsville, Texas, as recorded in Volume 61, Page 340 of the Deed Records of Walker County, Texas, and situated between Lots 6 and 7 on said plat and shown on Exhibit "A" attached hereto is hereby abandoned as street right-of-way, and said property may be sold by quit claim deed to John Amick, Jr., an adjoining property owner, for the cash consideration of One Thousand Six Hundred Seventy-Seven Dollars ($1,677.00). The City Manager of the City of Huntsville, Texas, is hereby authorized to execute a quit claim deed on behalf of the City conveying said right-of-way to John Amick, Jr. SECTION 2: This Ordinance shall take effect immediately from and after the date of its passage.
