ORD 2002-14 - Create Economic Development Council 08-06-2002ORDINANCE NO. 2002-14 AN ORDINANCE AMENDING ORDINANCE NO. 2001-25, AN ORDINANCE CREATING THE HUNTSVILLE ECONOMIC DEVELOPMENT COUNCIL BY AMENDING SECTION 1 BY CHANGING THE CREATION AND NUMBER OF MEMBERS AND THEIR TERMS; PROVIDING FOR A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council created a 13-member Huntsville Economic Development Council (the "HEDC") with each member serving a two-year term; and WHEREAS, the City Council desires to appoint individuals holding certain positions within the community to the HEDC and not restrict the term of those individuals; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: Ordinance No. 2001-25, Section I a) Creation; number of members and Section 1 b) Terms staggered are hereby amended to read as follows: Section 1: There is hereby created the Huntsville Economic Development Council which shall be governed by the following rules and regulations: a) Creation; number of members. The council provided for herein shall be comprised of fourteen members. Five (5) members will be the individuals holding the positions of President/CEO, Huntsville-Walker County Chamber of Commerce; Chairman of the Board, Huntsville-Walker County Chamber of Commerce; Walker County Judge; Superintendent, Huntsville Independent School District; and Mayor, City of Huntsville. These five members shall serve on the council so long as they hold their respective elected or appointed positions. The remaining nine (9) members of the council (hereinafter referred to as "at-large council members") shall be recommended by the Mayor and approved by the City Council. The name of the council may be changed or amended by resolution of the City Council. The City Manager shall serve as an ex-officio member of the council. b) Terms staggered. The term of each at-large council member shall be two (2) years with the terms staggered so that five (5) members are appointed one year and four (4) members appointed the next year. Four (4) at-large council member positions will be filled in 2002. SECTION 2: If any portion of this Ordinance shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the City Council determines that it would have adopted this Ordinance without the invalid provision.
