ORD 2003-12 - Amend Water & Sewer Code of Ordinances 09-16-2003ORDINANCE NO. 2003-12 AN ORDINANCE AMENDING TITLE 30, WATER AND SEWERS, OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, INCREASING THE TAPPING CHARGES FOR WATER AND SEWER SERVICE; DECREASING THE RATE FOR RESIDENTIAL WATER SERVICE; AND CHANGING THE CALCULATION FOR SEWER SERVICE PROVIDED BY THE CITY; MAKING OTHER PROVISIONS AND FINDINGS THERETO; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: Title 30, Water and Sewers of the Code of Ordinances of the City of Huntsville, Texas, Sections 31.01.02 "Water tapping charge" and 31.01.07 "Monthly charges for water" are hereby amended as follows: Section 30.01.02 Water tapping charge. A. The following charge shall be assessed and collected by the City of Huntsville for water taps: 1. Three- fourths -inch water tap 2. One -in water tap $450.00 $500.00 B. All other water taps and special water connections shall be made at actual cost as determined by the director of public works or his/her designee. Section 30.01.07 Monthly charges for water. A. Residential and Commercial rate schedule. Except for contractual customers, residential and commercial users supplied with water service by the city shall be charged a monthly water service charge based upon the size of the meter and the amount of water consumed by the user and applied to the following rate schedule: Single Family Residential Gallons of Water Used per Month First 3,000 minimum monthly charge Between 3,000 — 12,999, per 1,000 gallons All over 13,000, per 1,000 gallons Commercial — Gallons of Water Used per Month First 3,000 minimum monthly charge All over 3,000, per 1,000 gallons Page 1 of 3 Amount or Rate Charged See Meter Size Table below $2.25 $2.64 Amount or Rate Charged See Meter Size Table below $2.64 Meter Size Minimum Monthly Charge .75 $15.00 1 21.00 1.5 27.00 2 43.50 3 165.00 4 210.00 6 315.00 8 435.00 Rates for residential and commercial customers located outside the City limits are calculated in the same manner as rates developed for customers located within the City limits; however; a multiplier of 1.25 shall be applied to the two cost components above. SECTION 2: Title 30, Water and Sewers of the Code of Ordinances of the City of Huntsville, Texas, Section 30.02.01, Subsections B.1. and G. "Monthly charges for sewer" and Section 31.02.05A. "Sewer tapping charge" are hereby amended as follows: Section 30.02.01 Monthly charges for sewer. B. Residential rate schedule. Individually metered single residential units. Each individually metered residential dwelling unit supplied with sewer service by the City shall be charged for and owe each month a wastewater service charge and a volume charge based upon average water consumed during the months of November, December, January, and February of each fiscal year, rounded to the nearest 100 gallons, as determined by the meter reading, applied to the rate schedule. The monthly billing will be determined on this average. Customers moving onto an existing single family residential unit shall be billed based on the past history of usage at such residential unit, if known, or if not known, at eighty percent (80 %) of current monthly consumption up to a maximum monthly amount for 10,000 gallons until the winter month history is established. New residential units shall be billed at 80% of current monthly consumption up to a maximum monthly amount for 10,000 gallons until the winter month history is established Gallons of Water Used per Month Amount or Rate Charged first 2,000 minimum monthly charge $15.00 all over 2,000, per 1,000 gallons $ 4.87 G. Users without city water. Residential customers not connected to the waterworks system of the city shall be billed monthly by the city for wastewater services at a calculated rate based on the average residential water consumption of sixty -eight hundred (6,800) gallons, or at a rate based on the average water consumed during the months of November, December, January and February of each fiscal year Page 2 of 3 from the billing records of a special water district. Commercial customers shall be billed at a rate that is consistent with the regular wastewater charge of similar type businesses, premises or users receiving service from the city. The utility office supervisor shall recommend for approval such service charge and conditions as deemed appropriate to the Finance Committee of the City Council and the Finance Committee shall approve the same. Section 30.02.05 Sewer tapping charge A. Except as herein provided, the following charge shall be assessed and collected by the city for sewer taps or services: 1. Minimum fee for the location of sewer stub or any connections to sewer system $100.00 2. Four -inch sewer tap $450.00 SECTION 3: All ordinances that are in conflict with the provisions of this Ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 4: Should any paragraph, sentence, clause, phrase or section of this Ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid, illegal or unconstitutional. SECTION 5: This Ordinance shall take effect immediately from and after the date of its passage, but the increased fees adopted by this Ordinance shall become effective on September 16, 2003, for bills mailed out after October 1, 2003.
