'BE IT ORDAIVED by the City Council of the City of Hunts -
ville, Texas:-

That the plans and specifientions filed with the City

S,ecretary by D. K. Caldwell covering the improvement of a portion
of Avenue Ot extending from its intersection with the South lire
of Eleventh Street South to a point Opposite tl,e entrance to the
Huntsville Venorial Hospital, he and the Same is hereby approved
and adoPted.
II.
The bid of G. L. Clark for said Street improvement, be-
ing they lbiuest and best bid offered, is hereby accepted and said
contract. is awarded to the said G, L. Clark,
III.
It is further ordained that the Honorable Sam IcKirney,
Mayor, be and he is 'rereby authorized to enter into a cortrn,ct
with the said G. L. Clark for said Street in-PrOvement in accordance
V'ith said plans and soeaffications and the bid of the said G. L.
Clark, and take from said bidder a good and sufficient bond, with
some Surety Company as :`urety thereon, in a sum not less than
one-half the total Contr,,ct price for said Street improvement, and
which said contract and bond shall be reported to the City Council
for approval.
IV,
It is further ordained that the contract and bond 0or-
templated for sF,id improvement Shall be entered into and executed
by the abutting property orrers as First Parties, composed of the
following: to-wit : Mrs, Uary R, Smitherg widow,, -the Estate of W. L.
Smitherg decen.sedg the Estate of g, _11,. Smithert deceased, and Gabe
J. V. Butler and Huntsville kemorial Hospital, a corpora-
tion, as First Parties; G. L. Clark, as Second Party; and the City
Of Huntsville, Texas, as Third Party. And shall provide for the
payment by the First Parties of all of the cost of said street
improvement,, le--s the portion thereof to be paid by the City of
Huntsville, as Third Party# In accordance witi-I the amount of the
frontage oared by said First Partiee, respectively# abutting said
Street to be improved. That the City of Huntsville, as Third Party,
shall pay not more than one-third of the entire cost of said im-
provement and the abutting property avvrers,, Virst Parties, shall
pay the balance of the cost of said Street, improvement.
V.
It is further ordained that the Second Party shall raive
all statutory and contract liens Provided by law for secliring the
cost Of 00.1d `street improvement,, and will look to the parties to
said contract for the Payment of the cost Of said improvement, as
stipulated herein, upon the Tzitten obligF tion of the parties
liable therefor as in said contract specified.
The above and foregoing ordinance was referred to the
Street and Bridge Committee and by said Committee referred back
to the City Council that the same be adopted, and said ordinance
was duly adopted and approved on this 5th day of January, 1932,
at a regulvIr meeting of said Council, a quorum being present.
