AN ORDINANCE AMENDING TITLE 25, "STREETS AND SIDEWALKS," TO
ADD A SECTION ADDRESSING THE PROBLEM OF SEDIMENT, MUD AND
EROSION FROM CONSTRUCTION SITES, SITE CLEARING OPERATIONS AND
LOGGING OPERATIONS CREATING NUISANCES AND HAZARDS ON PUBLIC
STREETS AND SIDEWALKS; RENUMBERING OF SECTIONS AS
NECESSITATED BY THE ADDING OF A NEW SECTION; AND PROVIDING A
PENALTY CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
SECTION 1: A new Section 25.02.17, to be entitled "Temporary Sediment and Erosion Control," is added to
the Huntsville, Texas, Municipal Code to provide as follows:
25.01.17 Temporary Sediment and Erosion Control. Prior to development of property,
removal of vegetation, logging, or any disturbance of natural or paved ground which may
cause sedimentation or erosion from or on that property, erosion control measures must be
installed. Temporary sediment control fencing, sandbags, hay or an approved engineered
erosion control system must be used. Fencing, sandbag, and hay methods must be installed in
accordance with City of Huntsville specifications as provided by the City of Huntsville
engineer.
SECTION 2: The Section presently numbered 25.01.17, entitled "Penalties," is now renumbered 25.01.18
and is amended to read:
Section 25.01.18
Any person, firm or corporation who shall violate any of the provisions of section 25.01.11
through 25.01.17, or who shall fail to comply with same shall be guilty of a misdemeanor and
upon conviction thereof shall be punished by fine. Each and every day or fraction thereof
which said sections or any part thereof shall be violated, shall be deemed a separate offense.
SECTION 3: Since this Ordinance has a penalty for violation, it shall not become effective until after its
publication in the newspaper as provided by Section 4.15 of the Charter of the City of Huntsville, Texas. This
Ordinance shall become effective on April 3, 2004.
