ORD 2005-05 - Runoff Election Mayor At-Large 05-17-2005ORDINANCE NO. 2005-05 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ORDERING A SPECIAL RUNOFF MUNICIPAL ELECTION TO BE HELD ON THE 11TH DAY OF JUNE, 2005, FOR THE PURPOSE OF ELECTING THE MAYOR AT LARGE; PROVIDING FOR ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING THE ELECTION; AND PROVIDING FOR THE POSTING AND PUBLICATION OF THIS NOTICE. SECTION 1: A special runoff municipal election of the City of Huntsville, prescribed by Section 6.02 of the City Charter, shall be held between the hours of seven (7:00) o'clock a.m. and seven (7:00) o'clock p.m. on the 11th day of June, 2005, in the City for the purpose of election the Mayor At- Large. The candidates for Mayor At -Large are Vance Howard and J. Turner. SECTION 2: The City is hereby divided into seven (7) election precincts. Leroy Hall 634 Cherry Hills Connie Hardy 206, Ward 2 Region VI Education Building Patricia Hipps 3332 Montgomery Rd./FM 1374 Sandra Gray 301, Ward 3 Martin Luther King Center Betty Haynes 300 Avenue F Jean Burton 401, Ward 4 Second Baptist Church Sissy Johnson 720 South Sam Houston Helen Belcher SECTION 3: This election shall be held in accordance with, and shall be governed by, the Election Laws of the State of Texas. In all City elections, the Mayor, City Secretary or City Council shall do and perform each act as in other elections required to be done and performed, respectively, by the County Judge, the County Clerk or the Commissioners' Court. SECTION 4: The Mayor At -Large shall be selected from the City precincts by a majority of the registered voters of the City and voting in the runoff election. The Mayor At -Large elected shall hold office for a period of two (2) years. SECTION 5: The Mayor At -Large shall be a citizen of the United States, qualified voters of the State of Texas, a resident within the present corporate limits of Huntsville for at least twelve (12) months, reside in the ward in which they are a candidate, and be current in payment of taxes and assessments due to the City. SECTION 6: The order in which the names of the candidates are to be printed on the ballot shall be determined by a drawing of the City Secretary as provided by section 52.094 of the Texas Election Code, after 24 hours posted notice. The form of the ballot for the election shall be as follows: OFFICIAL BALLOT Runoff Election City of Huntsville, Texas June 11, 2005 INSTRUCTION NOTE: Vote for the candidate of your choice in each race by placing an "X" in the square beside the candidate's name. Mayor At -Large (Vote for one) ❑ (candidates' name) ❑ (candidates' name) SECTION 7: City Secretary Danna Welter is appointed as the Early Voting Clerk, and City Hall 1212 Avenue M Huntsville, Texas 77340 is designated as the place for early voting for the election. The beginning date of early voting shall be May 25, 2005, and the last day of early voting shall be June 7, 2005. During the lawful early voting period, the early voting clerk shall keep the place for early voting open for early voting from 8:00 a.m. to 5:00 p.m. on each day except Saturdays and Sundays, and official state holidays. SECTION 8: Diana Keough is appointed as the presiding judge of the early voting ballot board and is directed to perform the duties required of such by Chapter 87 of the Texas Election Code. SECTION 9: The Mayor and City Secretary are directed to give notice of the election by: a) publishing the notice at least ten (10) days before the election in the newspaper (Huntsville City Charter section 6.02); and b) posting at the City Hall bulletin board notice of the election at least fifteen (15) days before the election (Texas Election Code section 2.026). The Mayor and City Secretary shall file with the City Secretary a copy of the notice as published, together with the name of the newspaper and the dates of publication. SECTION 10: This ordinance shall take effect immediately from and after its passage. PASSED AND APPROVED this the 171h day of May 2005.
