ORD 2006-26 - Adopt Code of Ordinances Title 20, Angle Parking 10-17-2006ORDINANCE NO. 2006-26 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING TITLE 20, MOTOR VEHICLES AND TRAFFIC, OF ITS CODE OF ORDINANCES BY DESIGNATING VARIOUS CURB ZONES AND AREAS AS ANGLE PARKING; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, for a great number of years, the City of Huntsville has allowed and directed for angle parking on certain streets within the City, some being designated by pavement markings and accepted by longstanding practice; WHEREAS, at a point in time after the described angle parking was established in the City of Huntsville, Transportation Code section 545.303 was enacted providing "additional parking regulations;" and WHEREAS, the City desires its ordinances and traffic schedule to be reconciled and in conformity with said provision of the Transportation Code; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: All the above premises are hereby found to be true and correct legislative and factual findings of the City of Huntsville and are hereby approved and incorporated into the body of this ordinance as if copied in their entirety. City of Huntsville, Texas Traffic Schedules Ordinance Page 2 of 3 Section 4: The City Manager is authorized and directed to cause the posting of proper signs along the above described streets and parking zones. Section 5: It shall be unlawful for driver of a vehicle to disobey the instruction of the signs placed in accordance with the provisions of this ordinance unless at the time otherwise directed by a Police Officer. Section 6: Any person, firm or corporation violating any provision of this ordinance or failing to comply with any requirement of the ordinance will be guilty of a misdemeanor and subject to a fine of up to five hundred ($500.00) dollars upon conviction. Section 7: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this ordinance. Section 8: All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 9: This ordinance shall take effect ten (10) days after its passage by the City Council. The City Secretary shall publish the caption of this ordinance in the official City newspaper at least twice within ten (10) days of its passage. PASSED AND APPROVED THIS � DAY OF OdD %3e,,(— , 2006.
