ORD CC 03/29/1929 - party wall contract, Smither Grocery & fire station loti AN ORDINANCE OR RESOLUTION OF THE CITY OF HUNTSVILLE, TEXAS, DULY MBE AND ENTEITU D OF ?,EC ORD AT A SPECIAL METING THE CITY COUNCIL, I1ELD ON THE DAY OF RTARCH, 1929, AUTHORIZING INSTRUCTING SAM TIC- KIi��'NI+ , AS MAYOR, TO EXECUTE A PARTY WALL CONT JITII ST-TITHER GROCERY COMPANY, .WHICH SA ;- IS HERE REFL'RRED TO AND MADE A PART HEREOF, FOR FULL PAR- TICULARS. BE IT ORDAIITED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AS FOLLOWS $ 10�BREAS, the City of Huntsville, Texas, has contracted for the construction of a fire station and municipal building on its roperty in Lot 21, Block 7, of the City of Huntsville, Texas, and which said property is adjacent to the property of Smither Grocery Company, on the East and South sides thereof, and, in the construction of the foundation for the East and South "dalls of said building, it has become necessary to build the foundation beneath the surface of the soil to the extent of about fourteen (14 ") inches over on the property of said Smither Grocery Company. In consideration of the premises, it has been agreed by and between the City of Huntsville and said Smither Grocery Company that the City may build its laid foundation walls over upon the property of Smither Grocery Company, not to exceed fourteen (14" inches, but the walls themselves shall be on the line between the property of the City and Smither Grocery Company, and .,,iholly on the ,property; and, in consideration of such permission, the City has agreed to allow Smither Grocery Company, at any time hereafter, should it decide to construct a building on the East side of said City Building, or on the South side thereof, to use said East ­all and the South wall of said fire station for the construction of a @4 -ft-r building, but that the ownership of said wall shall be and remain the property of the City. The Hon.Sam McKinney is hereby authorized and directed to enter into a proper written contract covering said party yrall agree,nent.
