ORD CC 05/1927 - moving houses or buildings (page 2 long)r i �3 AN ORDINANCE TO AMEND AN ORDINANCE RE- GUL:�i ING THE MOVING OF HOUSES OR BUILD- INGS ALONG, OVER, UPON AND ACROSS THE STR ; ETS OF TH CITY OF HUNT "VILLE, AND PROVIDING it PENALTY, ADOPTED AUGUST 6, 19129 INCORPORATING THEREIN A PORTION OF SECTION IIIa, RELATING TO THE, PER- MITS FOR THE REMOVAL OF BUILI.;INGS, OF AN ORDINANCE ADOPTED THE 21st DAY OF JULY, 1926, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND DECLARING AN FI ERGENCY. a BE IT ORDAINED BY TWE CITY COUNCIL OF THE CITY OF HUNTSVILLE: ha,t the ordinance regulating the roving of houses or buildings along, over, upon and across the streets of the City of Huntsville, Texas, adopted August 6, 1912, and incorporation a portion of Section IIIa of an ordinance adopted by said City on Jaly 921, 1926, be amended and re- enacted so as hereafter to read as Follows: SECTION 1- It shall be unlawful for any person or persons to move any house or ;wilding of any kind along, over, upon, or :cross any streets of the City of funtsville, without first obtaining a written permit from the Building Inspector of said City. The granting of such permit shall be within the discretion of the Building Inspector, and the tayor of said City. Such permit, when granted, shall nz.:me the streets along, over, upon and across ;hick said douse or other buiidi_-,g is to be moved, the time when such building shall be begun, and the length of time conawned in the removal of such building; and that no such permit shall be issued until the fee of Five ($5.00) Dollars, hereby fixed for the issuance of a permit, shall have been laid and delivered to ',he City Secretary. SECTION 2 -- Before any person or persons shall be granted a permit to Move any house or other building along, upon, over or across any streets of the City of Huntsville, such person or persons shall enter into a good and solvent bond with one or more sureties, payable to and to be -2- r approved by the Mayor of the City of Huntsville, in a sum not less than Two Hundred. Fifty ($250.00) Dollars nor more than One Thousand ($1000.00) Dollars, conditioned that such person or persons shall not in any manner injure anJr person, or persons,or any property within the said City, and particularly lxiill not injury any of the side - ,Nalks, bridges, culverts, paving, streets, street - crossings, or other property belonging !.o said City, or property belonging; .o any rerson, firm or corporation located within said City. SECTION 3 -- That when any per: on or persons desiring to move a house or building; along, over, across or upon any of tine streets of the City of Huntsville, and small have obtained a permit therefor as provided in Section 1 above, and shall have uetually begun to move such house or building, such house or .Iuilding shall be moved as rapidly and expeditiously as possible, and the w6rk of moving said house or building shall progress continuously from day to day, Sundays excepted, so that said house or building may not remain an obstruction in or upon any of the streets of said. City longer than is absolutely necessary; and after the wor)� of moving said house or building shall have once begun, it shall be unlawful for the person or persons in charge of said ;cork to ,permit said house or building to remain stationary on or ul)on any of the streets of s:id City of Huntsville for as long as one -half day at a time, Sundays excepted, and each half day that said house or building shall be allowed to remain stationar-Z on or upon an,,- of the streets of t_�e City of Huntsville shall be deemed as a separate offense. SECTION 3A -- Any person moving any douse (or other structure) upon, over, or acrass the streets otf the City of Huntsville, under a permit issued by virtue of this ordinance, when it becomes necessary to _.eave such ho1.se (or other structure) upon and -.,ithin any street during the night, shall keep colored - -ights exposed adjacent to said house (or other structure) on each end, or side, -.-J lere the s�reet may bo obstructed by suer. house (or other structure), in order to protect persons upon said streets from running into, or colliding, with, such house (or otr:er structure) ; and a violation o' this section s% :ail be deemed a mis6emeanor, and upon conviction the°eof subjedt the party violating the same to a fine of not less than Ten ($10.00) Do]_lsrs nor more than Fifty Dollars. -2- approved by the Mayor of the City of Huntsville, in a sum not less than Two Hundred .Fifty (250.00) Dollars nor more than One Thousand ($1000.00) Doilars, conditioned that such person or persons shall not in any manner injure any person, or persons,or any property within the said City, and particularly will not injury any o£ the side - walks, bridges, culverts, paving, streets, street - crossings, or other property belongint_ !.o said City, or property belonging; _o any ;,er:-on, firm or corporation located within said City. SECTION 5 -- ot.ing in this ordinance shall be construed to curtail or abridge the right of any person to prosecute a civil action for damages by reason of injuries Uo persons or property resulting from the use of any of the streets of the City of Huntsville by any person or persons moving any =douse or building, along, over, across or upon such streets. SECTION 6-- Any person violating any of the provisions of this ordinance si.all be deemed guilty of an offense, and unon conviction theroof shall be fined in any sum not less t- -an Ten ($10.00) Dollars nor greater than One hundred 0100.00) Dollars, SECTIO; 7 -- This ®rdinance shall be construed in cannection with the building ordinance of the City 0'1- Iuntsville adopted July 21, 1920, and all other ordinances in conflict with the provisions hereof are hereby repealed. SECTION 8-- There being a public emercency requiring treat t1lis Ordinance shall be passed finally on the date it is introduced, the same shall take effect and be in force orce from and L-1j"ter its passage.
