MINUTES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 12TH DAY OF APRIL, 1994, IN THE CITY

The Council met in regular session with the following members present:

CITIZEN INPUTlINQUIRY
Paul Palmer. Mr. Palmer requested that Council consider repealing its ordinance prohibiting pre - recorded messages. He
is marketing a product for the elderly where they push a button to send a pre- recorded message to the Police Department in
emergency situations.
Mayor Hodges stated that he would refer this item to staff.
Bette Nelson. Ms. Nelson stated that the downtown merchants are still having problems with parking for downtown
visitors. She asked City Council to address this problem. She also stated that several of the ornamental lighting fixtures have been
down for an extended length of time and requested that they be replaced.
Mayor Hodges referred these items to staff.

CONSIDER MINUTES OF MARCH 29, 1994
Councilmember Luning made the motion to approve the minutes of March 15, 1994. and Councilmember Rex seconded
the motion. All were in favor and the motion passed unanimously.
CONSIDER AN INTERLOCAL AGREEMENT WITH THE TEXAS DEPARTMENT OF CORRECTIONS
FOR USE OF A LADDER FIRE TRUCK
Councilmember Lange made the motion to approve an interlocal agreement with the Texas Department of Corrections for
use of a ladder fire truck, and Councilmember Rex seconded the motion. All were in favor and the motion passed unanimously.
CONSIDER A PROPOSAL BY HABITAT FOR HUMANITY TO FACILITATE
HOUSING STOCK ACQUISITION AND RESTORATION FINANCING
Mr. Wilbur Moore asked Council for the City to be the agent to claim tax sale lands and transferthese properties to Habitat
for Humanity to be restored for low income housing. He stated that Habitat for Humanity has been allocated grant funds for
rehabilitation of properties.
Mayor Hodges referred this item to staff.
CONSIDER A REQUEST BY THE GIRLS SOFTBALL ASSOCIATION FOR PERMISSION TO PLACE A
PORTABLE BUILDING ADJACENT TO THE LOWER FIELDS CONCESSION STAND AT KATE BAR ROSS PARK
Councilmember Luning made the motion to approve a request by the Girls Softball Association for permission to place
a Dortable building adiacent to the lower fields concession stand at Kate Barr Ross Park, and Councilmember Matthews seconded

CONSIDER A PROPOSAL TO AUTHORIZE THE CITY MANAGER TO EXECUTE AN AMENDMENT
TO THE CONTRACT FOR SOLID WASTE DISPOSAL SERVICES WITH WASTE MANAGEMENT
FOR COLLECTION OF CONSTRUCTION, DEMOLITION AND MANUFACTURED WASTE FOR DISPOSAL
Mr. Wilder stated that Waste Management has offered to service our customers inside and outside the City limits that
require the construction, demolition and manufactured waste disposal. The rates offered are reasonable considering the additional �
hauling costs.

CONSIDER A WATER SERVICE REQUEST BY WES ALTOM (BADGER SUBDIVISION)
AND CONSIDER POLICIES ADDRESSING UTILITY SERVICE OUTSIDE THE CITY LIMITS
Mr. Pipes suggested the following policy positions:
Single lot, residential developments which meet all platting requirements and are located within the City's ETJ
proceed under the Development Code and subsequent administrative procedures and not require additional Council a

CONSIDER NOTICE OF CLOSING OF U.S.E.P.A. - M.W.P.P. AUDIT PROCEDURE
Mr, Wilder stated that in 1991 administrative orders were issued to the City mandating completion and submittal of al',
Municipal Water Pollution Audit for each of our wastewater treatment facilities beginning in calendar year 1991. The City has
completed three years of audits for its two plants. The City has now received letters from EPA official closing the administrative''
orders because "EPA did not obtain the necessary approval from the Office of Management and Budget under the Paperwork',
Reduction Act to require the self - audits or the submission of self - audits to EPA."
CONSIDER BIDS
1. Bid 94 -15 - Rubber Tire Wheel Loader to Mustang Tractor with trade -ins of $32.950 as budgeted.
2. Bid 94 -16 - Stationary Mount Solid Waste Loader to Gulf States Crane and Equipment in the amount of $57,586.90
as I
budgeted.
3. Renewal of Annual Janitorial Service to Byrd Janitorial as budgeted.
4. Digital Duplicating Machine to AB Dick in the amount of $7.165 as budgeted.

CONSIDER A PARKING LOT LEASE PROPOSAL FROM THE HONORABLE ERWIN G. ERNST
rIt was noted that the City had received a letter from Erwin G. Ernst about the rental of a lot at the intersection of Avenue
M and 12th Street for public parking for "a nominal 3 4% of its value per annum".
It was suggested that perhaps Judge Ernst should be referred to the County.
CONSIDER A PROPOSAL TO PLACE "WELCOME TO HUNTSVILLE" SIGNS
AT THREE LOCATIONS IN THE AMOUNT OF $15,000 (RESERVE FOR FUTURE ALLOCATION)
Mr. Schindler stated that staff has reviewed and identified suitable locations for "Welcome to Huntsville" signs including
11th Street at Hickory, Highway 75 at 7th Street, and FM 2821 at the Diagnostic Unit. Staff is requesting approval of the locations
and expenditure of $15,000 from the reserve for future allocation.
Councilmember Matthews stated that her constituents did not feel that the City should fund $15,000 for signage since a
social worker was not funded in last yews' budget.
Councilmember Lange made the motion to approve the expenditure of $15,000 for the Welcome to Huntsville signs, but
that the locations be considered at a later date, and Councilmember Rex seconded the motion. All were in favor except
Councilmember Matthews. The motion passed 8 -1
CONSIDER A MUSEUM ADVISORY BOARD RESOLUTION CONCERNING SIDEWALK IMPROVEMENTS
ON 19TH STREET BETWEEN SAM HOUSTON AVENUE AND AVENUE O
Mr. Patrick Nolan, Director of the Sam Houston Memorial Museum sent a letter /resollution stating that the condition of
the sidewalk along 19th Street between the site of the new Education Center and the Steamboat House is badly deteriorated and
presents a public safety danger to pedestrians.
Mayor Hodges stated that this request for sidewalk will be discussed during the upcoming budget sessions. Councilmember
Norton stated that this was not the only area in need of sidewalks and suggested an overall review of the sidewalk needs.
MAYOR'S ACTIVITY REPORT
Mayor Hodges stated that he was to attend a reception in honor of Joe Mac Henry for his 40 yews in the automobile
business later this evening.
CITY COUNCILMEMBER ACTION
Nations Bank. Councilmember Davis advised City Council that the City of Huntsville has opened an account with Nations Bank
Texas to use as a clewing account for the purchase of securities. In addition, the City has entered into a third party safekeeping
agreement arrangement with them.
