ORD 2007-10 - Amend Code of Ordinances Title 14, Heavy Trash Collection 03-03-2007ORDINANCE 2007 -10 AN ORDINANCE AMENDING TITLE 14 GARBAGE, REFUSE AND RUBBISH OF THE HUNTSVILLE, TEXAS MUNICIPAL CODE REVISING YARD WASTE TRIMMINGS, AND ADOPTING HEAVY TRASH AND LARGE YARD WASTE COLLECTION PROCEDURES, CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Huntsville is a home rule city acting under its charter adopted by the electorate pursuant to the Texas Constitution and the Local Government Code; WHEREAS, the City of Huntsville has been collecting yard waste on a call -in basis since October 1, 2005; WHEREAS, the City of Huntsville was awarded an H -GAC grant and purchased a new Heavy Trash Truck with dual loader/ grapple; WHEREAS, the City of Huntsville desires to amend its yard waste collection program and include a heavy trash /large waste collection; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: SECTION 1. Title 14 Garbage, Refuse and Rubbish, Section 14.01.01 Definitions is hereby amended to read: Section 14.01.01 Definitions. Ashes . Residue from burning of wood, coal or combustible material. Commercial unit . Any structure or building or other premises not used exclusively for residential occupancy. Garbage . Putrescible animal and vegetable wastes resulting from handling, preparation, cooking or consumption of food. Refuse . All putrescible and nonputrescible solid wastes (except body wastes) including garbage, rubbish and ashes. Rubbish . Nonputrescible solid waste (except ashes) consisting of both combustible and noncombustible wastes. March 29, 2007 Page 1 of 4 Heavy Trash . Large vard waste, furniture, appliances /white goods, building construction material, and miscellaneous heavv debris. (Ord. No. 82 -4, § 1, 2- 16 -82) SECTION 2. Title 14 Garbage, Refuse and Rubbish, Section 14.01.08 Preparation of refuse for collection is hereby amended to read: Section 14.01.08 Preparation of refuse for collection. A. All refuse, including garbage, shall be drained free of all liquids. B. Tree trimmings, hedge clippings and similar material shall be cut into lengths not to exceed four (4) feet, no larger than four (4) inches in diameter and securely tied in bundles not more than two (2) feet thick or weighing more than fifty (50) pounds. All leaves, grass, pine needles, or an Iy oose yard waste material must be placed in plastic or paper bags or containers, weighing not more than fifty (50) pounds. All material must be placed within ten (10) feet of the nearest city street. C. Large Yard Waste includes limbs and branches which must be prepared for Dick u by using the following guidelines: 1) Limb and branches up to a maximum ofeight (8) feet in length which should be placed curbside and cut ends must face the road. 2) Tree limbs larger than twelve (12) inches in diameter must be cut to a maximum three (3) feet in length. 3) Large brush must be stacked, unbound and in one row along the road edge no higher than four (4) feet. D. These items shall be placed in separate Diles alone the road edge 1) Appliances /White Goods such as refrigerators, freezers, stoves washers, dryers, hot water heaters and miscellaneous metal appliances (door removed. 2) Building Construction Material such as lumber, doors, windows, etc. 3) Miscellaneous Heavy Debris including large boxes, moving debris, and tires removed from the rims. The City will not collect tractor tires. E. Items shall be placed along road edge approximatelg five (5) feet from garbage cans and other obstacles such as mail boxes fences and parked cars. Avoid placing large brush and bulky items under low - hanging tree limbs or power lines. F. The following items are not collected as part of the "Heavy Trash /Large Yard Waste Collection "pro rg am: 1) Loose or bagged household garbage. 2) Tractor tires. March 29, 2007 Page 2 of 4 G. A person commits an offense if he places hot ashes in any receptacle or container for collection by the city refuse collection service. H. All refuse shall be placed into approved refuse containers. I. All boxes and cartons shall be broken down and placed in refuse containers. (Ord. No. 82 -4, § 1, 2- 16 -82) SECTION 3. Title 14 Garbage, Refuse and Rubbish, Section 14.02.01 Residential Collection is hereby amended to read: Section 14.02.01 Residential collection. A. The city shall collect residential refuse twice per week. B. The city shall provide collection service for tree trimmings and clippings on the first, third and fifth (when applicable ) Wednesday of each month, except for weeks with a city holiday. C. The citv shall provide Heavy Trash /Large Yard Waste collection service on the second and fourth Wednesdays of each month on a call -in basis Requests for pick up shall be placed a minimum of one (1) week prior to the scheduled collection day. No heavv trash intended for municipal collection may be placed at the road edge earlier than five (S) days prior to the scheduled collection day. Heavv trash includes large Yard waste, furniture appliances /white goods building construction material and miscellaneous heavv debris. (Ord. No. 82 -4, § 1, 2- 16 -82) SECTION 4. SEVERABILITY CLAUSE If any part of the provision of this ordinance or the application of this ordinance to any person or circumstances is adjudged invalid by any court of competent jurisdiction, the judgment shall be confined in its operation to the part, provision, or application directly involved in the controversy in which the judgment shall be rendered and it shall not affect or impair the validity of the remainder of these regulations or the application of them to other persons or circumstances. The City Council hereby declares that it would have enacted the remainder of these requirements even without any such part, provision, or application which is judged to be invalid. SECTION 5. EFFECTIVE DATE This ordinance shall be in full force and effect on May 1, 2007. PASSED AND APPROVED this 3rd day of March, 2007.
