Resolution 2014-11 - Reso. 2014-11 - McCaffety local bidder for Elkins Lake lift station generator, signed 4-1-14RESOLUTION NO. 2014 -11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AWARDING THE BID FOR THE ELKINS LAKE DAM LIFT STATION GENERATOR TO THE LOCAL BIDDER, MCCAFFETY ELECTRIC. WHEREAS, the City Council advertised and requested bids for the purchase of one 200 KW generator to be placed at the Elkins Lake Dam Lift Station; and WHEREAS, the City has reviewed the bid from the low bidder Generators of Houston, in the amount of $46,510.00; and the local bid from McCaffety Electric, in the amount of $47,665.00, and find both acceptable; and WHEREAS, the Texas Local Government Code Section §271.9051(b) provides: (b) In purchasing under this title any real property, personal property that is not affixed to real property, or services, if a municipality receives one or more competitive sealed bids from a bidder whose principal place of business is in the municipality and whose bid is within five percent of the lowest bid price received by the municipality from a bidder who is not a resident of the municipality, the municipality may enter into a contract with: (1) the lowest bidder; or (2) the bidder whose principal place of business is in the municipality if the governing body of the municipality determines, in writing, that the local bidder offers the municipality the best combination of contract price and additional economic development opportunities for the municipality created by the contract award, including the employment of residents of the municipality and increased tax revenues to the municipality. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: City staff is authorized to execute all documents necessary to purchase one 200 KW generator from the local bidder, McCaffety Electric, in the amount of $47,665.00, and the City Council determines that McCaffety Electric is a local bidder and offers the City of Huntsville the best combination of contract price and additional economic development opportunities for the City of Huntsville created by the contract award, including the employment of residents of the City of Huntsville and increased tax revenues to the City of Huntsville. The draft minutes reflect: Mayor Woodward moved to amend the motion to replace Generators of Houston with McCaffety Electric for the purchase and was seconded by Councilmember Brauninger. The Mayor amended his amended motion so that it be contingent on presentation of the required findings and was seconded by Councilmember Montgomery. The amendment to the amended motion passed unanimously The amended motion passed unanimously. The amended main motion passed unanimously, This can be interpreted that it has to go back to council or that if the findings or given to the Mayor he can sign the resolution based on the approval of the motion. Most times when a motion is made "contingent' on, it means staff confirms and then the approved item takes effect.
