ORD 2008-07 - Amend Title 20, Motor Vehicle & Traffic (No Parking 21st St Between L 1/2 & Ave N) 02-19-2008ORDINANCE NO. 2008-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING TITLE 20, MOTOR VEHICLES AND TRAFFIC, OF ITS CODE OF ORDINANCES BY ADDING NO PARKING RESTRICTIONS ALONG 21" STREET BETWEEN LM STREET AND AVENUE N; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: The following described curb zones and areas are hereby amended as follows: Street Name Side of Street Add the following to Schedule III: 21" Street South 21' Street South Limits Avenue Nto 228' east of Avenue N L112 to Avenue M Section 2: Schedule III, No Parking Zones, of Title 20, Motor Vehicles and Traffic, of the Code of Ordinances of the City of Huntsville, Texas, shall be revised to reflect the amendments made by this ordinance. Section 3: The City Manager is authorized and directed to cause the posting of proper signs along the above described streets and parking zones. Section 4: It shall be unlawful for driver of a vehicle to disobey the instruction of the signs placed in accordance with the provisions of this ordinance unless at the time otherwise directed by a Police Officer. Section 5: Any person, firm or corporation violating any provision of this ordinance or failing to comply with any requirement of the ordinance will be guilty of a misdemeanor and subject to a fine of up to five hundred ($500.00) dollars upon conviction. Section 6: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this ordinance. Section 7: All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 8: This ordinance shall take effect ten (10) days after its passage by the City Council. The City Secretary shall publish the caption of this ordinance in the official City newspaper at least twice within ten (10) days of its passage. PASSED AND APPROVED THIS 19TH DAY OF FEBRUARY 2008. Department Head Approval: SES Amendment to Code of Ordinances, Title 20, Motor Vehicles and Traffic ITEM DESCRIPTION: Agenda item seeks City Council approval to adopt Ordinance No. 2008 amending Schedule III, No Parking Zones, of Title 20, Motor Vehicles and Traffic, of the Code of Ordinances. This amendment will prohibit parking on the south side 213` Street between L1 /2 Street and Avenue N at the locations shown in the Ordinance. RESULT to be ACHIEVED: Amend the traffic schedule to prohibit parking along the south side of 2151 Street between 1-112 and Avenue Nat the locations shown in the Ordinance. This would allow safe passage of emergency vehicles down this street. BACKGROUND: Currently, parking is allowed on the south side of 21s1 between L1 /2 Street and Avenue N. Some complaints have been received about the current parking situation. It appears SHSU students are parking along this street in addition to residents. Due to the narrow width of the street, parking along both sides will hinder the safe passage of emergency vehicles. Also, residents have experienced difficulty entering the street from their properties.. As per Section 20.02.02 of the Code of Ordinances, a trial period of prohibiting parking on the south side was implemented. There were no problems noted or complaints received. FISCAL IMPACT/ FUNDING SOURCE. Fiscal Impact: none Funding Source: none WMENDED MOTION: I recommend adopting Ordinance No. 2008- amending Schedule III, No Parking Zones, of Title 20, Motor Vehicles and Traffic, of the Code of Ordinances.
