ORD 2008-01 - Amending Personnel Rules Ch 4 (ORD 2005-17) 01-22-2008ORDINANCE 2008 -01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING THE PERSONNEL RULES OF THE CITY OF HUNTSVILLE BY AMENDING CHAPTER 4. WHEREAS The City of Huntsville Employee Policies and Procedures were originally adopted on September 20, 2005, by Ordinance No. 2005 -17; and WHEREAS The proposed policy Chapter 4, Section 7, Personal Leave grants personal leave for up to three (3) days to transact personal business. Personal leave may be substituted for Cinco de Mayo and Juneteenth as the City of Huntsville will no longer be observing these granted days as Holidays; and WHEREAS Other sections of the Employees Policies and Procedures are also being amended; and WHEREAS the Personnel Committee of the City Council has reviewed the recommended amendments as proposed by the City Manager and Director of Administrative Services; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: Chapter 4, Section 1, Paid Holidays of the Personnel Rules of the City of Huntsville, is hereby amended to read. Policy A. The following days are authorized holidays granted by the City: New Year's Day Martin Luther King's Birthday Good Friday Memorial Day Independence Day Labor Day Thanksgiving Day Day after Thanksgiving Christmas Day Additional Christmas Holiday January I" January 15`h The Friday before Easter Sunday May 30`h July 4`h First Monday in September Fourth Thursday in November Fourth Friday in November December 25`h Designated by City Council New Year's Day, Martin Luther King's Birthday, Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the Friday after Thanksgiving, Christmas Day and the additional Christmas Holiday are all fixed holidays. SECTION 2: Chapter 4, Section 7, Personal Leave of the Personnel Rules of the City of Huntsville, is hereby amended to add: 4.7 Personal Leave: Policy Personal leave for up to three (3) days is granted to every full -time City of Huntsville employee so that employees may receive paid time off to transact personal business. Procedure (1) Personal leave is time granted for discretionary purposes to every full -time City of Huntsville employee for three (3) days of each calendar year if he is on City of Huntsville payroll on the first day of the year. Employees not on the payroll on January 1 st, but who go on the payroll later in the year, may have personal leave in accordance with the following table: Date of Employment or Return from Leave of Absence After January 1, but before February 16 After February 15, but before April 16 After April 15, but before June 16 After June 15, but before August 16 After August 15, but before October 16 Number of Personal Leave Days Allowed for Remainder of Calendar Year After October 15, but before December 16 After December 15, but before January 1 2 'h 1 '/2 (2) Requests for personal leave should be submitted as soon as practicable in order to minimize any disruption to department operations. Department Heads may deny a personal leave request if the leave would interfere with the efficient and effective operations of the department or the City of Huntsville; in the event of an employee personal leave request, the Department Head shall apply the standard utilized for requests off on recognized national holidays. A request for personal leave may be denied if the employee is on a plan for improvement, disciplinary probation or has been disciplined in writing for poor attendance during the three months preceding the employee's request to use personal leave. Personal leave time may not be used to cover time missed from work while the employee is on FMLA leave (regular or intermittent), an extended medical leave of absence or any other leave of absence granted by the City of Huntsville. (3) Employees may not carry over unused personal leave from one calendar year to another. (4) Since an employee's absence on personal leave is time granted rather than earned, employees will not be reimbursed for unused personal leave. In addition, at the termination of an employee's service, there shall be no payment for unused personal leave. SECTION 3: This Ordinance shall take effect immediately.
