ORD 2009-59 - Extending Hours of Sale of Alcoholic Beverages 11-12-2009ORDINANCE NO. 2009 -59 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, CHAPTER 6 "ALCOHOLIC BEVERAGES" BY ADDING A NEW SUBSECTION 6 -4, ENTITLED "EXTENDED HOURS FOR THE SALE OF ALCOHOLIC BEVERAGES "; ADOPTING EXTENDED LATE HOURS FOR THE SALE OF ALCOHOLIC BEVERAGES; MAKING VARIOUS FINDINGS RELATED TO THE SUBJECT; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $500; AND PROVIDING FOR SEVERABILITY. WHEREAS, the City Council has studied the current provisions of the Code of Ordinances of the City to evaluate the need for updating regulations as they relate to the sale of alcohol and the provisions of the Texas Alcoholic Beverage Code regulating the hours of sale for such beverages; and WHEREAS, the Texas Alcoholic Beverage Code, Sections 105.3 and 105.05 provides that a city may extend the hours to sell and offer for sale mixed beverages and beer between midnight and 2:00 a.m. as authorized with an applicable permit ( "late hours "); and WHEREAS, the City Council finds and determines that it is appropriate, proper and in the best interest of the citizens of the City of Huntsville to adopt extended late hours for the City of Huntsville for the sale of such alcoholic beverages; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The Code of Ordinances of the City of Huntsville, Chapter 6, "Alcoholic Beverages" is hereby amended by adding a new subsection 6 -4 entitled "Extended Hours for the Sale of Alcoholic Beverages ", to provide as follows: "Sec. 6-4. Extended hours for the sale of alcoholic beverages. (a) Pursuant to Sections 105.03(d) and 105.05(d) of the Texas Alcoholic Beverage Code, as amended, extended late hours sale of alcoholic beverages are authorized in the city of Huntsville, as follows: (1) A holder of a mixed beverage late hours permit may sell and offer for sale mixed beverages between midnight and 2:00 a.m. on any day. Ord. Adopting Late Hours for Sale of Alcohol 091009 (2) A holder of a retail dealer's on- premise late hours license may sell, offer for sale, and deliver wine (as provided for under Section 105.04) or beer between midnight and 2:00 a.m. on any day," Section 3. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $500. Each day of violation shall constitute a separate offense. Section 4. All ordinances or parts of ordinances inconsistent or in conflict herewith are, to the extent of such inconsistency or conflict, hereby repealed. Section S. In the event any clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Huntsville, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts. Section 6. The City Council finds that notice was posted and the ordinance was passed in accordance with the Open Meetings Act. The City Secretary is hereby directed to cause the caption of this Ordinance to be published at least twice within ten days of final passage. This ordinance shall tale effect December 1, 2009.
